Rules 2012

In exercise of the powers conferred by section 88C of the Administration of Muslim Law Act, the Majlis Ugama Islam, Singapura, with the approval of the Minister for Communications and Information, charged with the responsibility for the portfolio of the Minister for Culture, Community and Youth relating to Muslim affairs, hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Administration of Muslim Law (Halal Certificates) (Amendment) Rules 2012 and shall come into operation on 19th November 2012.

Amendment of rule 2

2. Rule 2 of the Administration of Muslim Law (Halal Certificates) Rules (R 8) (referred to in these Rules as the principal Rules) is amended by inserting, immediately after the definition of “catering establishment”, the following definition:

“ “Government school” has the same meaning as in section 2 of the Education Act (Cap. 87);”.

Amendment of rule 3

3. Rule 3(2) of the principal Rules is amended by deleting the words “under section 88A(1) of the Act” and substituting the words “, or upon the grant of approval to use a specified halal certification mark, under section 88A of the Act”.

Deletion and substitution of Schedule

4. The Schedule to the principal Rules is deleted and the following Schedule substituted therefor:

(a)	issue of a halal certificate for a period of one year

4.	Endorsement of certified products:

(a)	issue of a halal certificate for imported, exported or re-exported products in respect of which a halal certificate has been issued

$150 per consignment

(b)	use of a specified halal certification mark or a mark similar to it

$0.30 per carton or per drum or, where a carton contains one or more smaller cartons, $0.30 per smaller carton (excluding the container of any such smaller carton or cartons)

5.	Operation of a product processing facility:

(a)	issue of a halal certificate for a period of one year for any premises not exceeding 200 square metres

(b)	issue of a halal certificate for a period of one year for any premises exceeding 200 square metres but not exceeding 750 square metres

(c)	issue of a halal certificate for a period of one year for any premises exceeding 750 square metres but not exceeding 2,000 square metres

(d)	issue of a halal certificate for a period of one year for any premises exceeding 2,000 square metres

(e)	use of a specified halal certification mark for each type or brand of a product manufactured, processed, prepared, stored or packed at the facility

$20 per product type or brand

6.	Operation of a retail food establishment:

(a)	issue of a halal certificate for a period of one year for any restaurant with a total floor area not exceeding 186 square metres

(b)	issue of a halal certificate for a period of one year for any restaurant with a total floor area exceeding 186 square metres

(c)	issue of a halal certificate for a period of one year for any food or hawker stall or any stall selling uncooked food

(d)	issue of a halal certificate for a period of one year for any food station in a restaurant

(e)	issue of a halal certificate for a period of one year for any halal section in a supermarket

(f)	issue of a halal certificate for a period of one year for any snack bar, confectionery or bakery (other than in a petrol station)

(g)	issue of a halal certificate for a period of one year for any snack bar, confectionery or bakery in a petrol station

(h)	issue of a halal certificate for a period of one year for any canteen stall in a Government school

(i)	issue of a halal certificate for a period of one year for any canteen stall in a staff canteen

(j)	issue of a halal certificate to any certificate holder to operate other than its certified premises for a period not exceeding 7 consecutive days in any bazaar, fair, trade exposition or other similar activity or event

7.	Operation of a catering establishment or central kitchen facility:

(a)	issue of a halal certificate for a period of one year for any premises (other than a facility referred to in paragraph (c)) not exceeding 186 square metres

(b)	issue of a halal certificate for a period of one year for any premises (other than a facility referred to in paragraph (c)) exceeding 186 square metres

(c)	issue of a halal certificate for a period of one year for any kitchen facility in a pre-school

8.	Issue of a halal certificate for a period of one year for the operation of a storage facility or warehouse or any section thereof

Transitional provision

5. Rule 4 shall apply to the issue of any halal certificate by the Majlis on or after 19th November 2012, notwithstanding that the application for the halal certificate is made before that date.
