Biological Agents and Toxins Act

(Chapter 24A)

Biological Agents and Toxins Act (Amendment of First and Second Schedules) Order 2009

In exercise of the powers conferred by section 62 of the Biological Agents and Toxins Act, the Minister for Health hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Biological Agents and Toxins Act (Amendment of First and Second Schedules) Order 2009 and shall come into operation on 1st December 2009.

Amendment of First Schedule

2. The First Schedule to the Biological Agents and Toxins Act is amended —

(a)

by inserting, immediately after item 7 in Part I under the heading “BACTERIA”, the following item:

“8. Any biological agent that is a constructed or reconstructed replication-competent form of any bacterium set out in this Part”;

(b)

by inserting, immediately after item 4 in Part I under the heading “FUNGI”, the following item:

“5. Any biological agent that is a constructed or reconstructed replication-competent form of any fungus set out in this Part”;

(c)

by inserting, immediately after item 11 in Part I under the heading “VIRUSES”, the following item:

“12. Any biological agent that is a constructed or reconstructed replication-competent form of any virus set out in this Part”;

(d)

by inserting, immediately after item 9 in Part II under the heading “BACTERIA”, the following item:

“10. Any biological agent that is a constructed or reconstructed replication-competent form of any bacterium set out in this Part”;

(e)

by inserting, immediately after item 2 in Part II under the heading “RICKETTSIAE”, the following item:

“3. Any biological agent that is a constructed or reconstructed replication-competent form of any rickettsia set out in this Part”;

(f)

by inserting, immediately after item 2 in Part II under the heading “FUNGI”, the following item:

“3. Any biological agent that is a constructed or reconstructed replication-competent form of any fungus set out in this Part”; and

(g)

by deleting the full-stop at the end of item 6 in Part II under the heading “VIRUSES”, and by inserting immediately thereafter the following item:

“7. Any biological agent that is a constructed or reconstructed replication-competent form of any virus set out in this Part.”.

Amendment of Second Schedule

3. The Second Schedule to the Biological Agents and Toxins Act is amended by deleting the full-stop at the end of item 14, and by inserting immediately thereafter the following items:

“15.—(1918) pandemic influenza virus

16. Any biological agent that is a constructed or reconstructed replication-competent form of any biological agent set out in this Schedule.”.
