Air Navigation Act
Chapter 6
Air Navigation (Amendment No. 3) Order 2003
In exercise of the powers conferred by section 3 of the Air Navigation Act, the Minister for Transport hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Air Navigation (Amendment No. 3) Order 2003 and shall come into operation on 12th December 2003.
Amendment of paragraph 2
2.  Paragraph 2 of the Air Navigation Order (O 2) (referred to in this Order as the principal Order) is amended —
(a)by inserting, immediately after the definition of “aeronautical radio station” in sub-paragraph (1), the following definition:
“ “aeroplane” means a power-driven heavier-than-air aircraft, deriving its lift in flight chiefly from aerodynamic reactions on surfaces which remain fixed under given conditions of flight;”;
(b)by inserting, immediately after the definition of “replacement” in sub-paragraph (1), the following definitions:
“ “required navigation performance” or “RNP” means a statement of the navigation performance necessary for operation within a defined airspace;
“RNP type” means a containment value expressed as a distance in nautical miles from the intended position within which flights would be for at least 95 percent of the total flying time;”; and
(c)by inserting, immediately after the words “aircraft radio” in sub-paragraph (6)(c)(ii), the words “and radio navigation”.
Amendment of paragraph 12
3.  Paragraph 12 of the principal Order is amended by deleting sub-paragraph (1) and substituting the following sub-paragraph:
(1)  An aircraft shall not fly unless it is so equipped with instruments and equipment as to comply with the law of the country in which it is registered, and to —
(a)enable the flight crew to control the flight path of the aircraft, carry out any required procedural manoeuvre, and observe the operating limitations of the aircraft in the expected operating conditions; and
(b)enable lights and markings to be displayed, and signals to be made, in accordance with this Order and any regulations made and requirements notified thereunder.”.
Amendment of paragraph 13
4.  Paragraph 13 of the principal Order is amended —
(a)by inserting, immediately after the word “radio” in sub-paragraphs (1), (2), (4) and (5), the words “and radio navigation”;
(b)by inserting, immediately after sub-paragraph (2), the following sub-paragraph:
(2A)  A Singapore aircraft operating under instrument flight rules shall not fly unless it is equipped with radio and radio navigation equipment to ensure that the failure of one item of such equipment at any stage of the flight does not prevent the aircraft from proceeding with the flight plan and in accordance with air traffic service requirements, including any additional requirements required to operate in the airspace specified in the Sixteenth Schedule, in defined portions of airspace or on routes where an RNP type has been notified, as the case may be.”; and
(a)by inserting, immediately after the word “Radio” in the marginal note, the words “and radio navigation”.
Amendment of paragraph 14
5.  Paragraph 14 of the principal Order is amended by inserting, immediately after the word “radio” in sub-paragraphs (1) and (2), the words “and radio navigation”.
Amendment of paragraph 35
6.  Paragraph 35(7) of the principal Order is amended by deleting the words “which is engaged on a flight for the purpose of public transport”.
New paragraph 36A
7.  The principal Order is amended by inserting, immediately after paragraph 36, the following paragraph:
Required navigation performance
36A.  A Singapore aircraft shall not fly in defined portions of airspace or on routes where an RNP type has been notified unless the aircraft —
(a)is equipped with navigation equipment which will enable it to operate in accordance with the notified RNP type; and
(b)is approved by the chief executive officer to operate in such airspace or on such routes.”.
Amendment of paragraph 44
8.  Paragraph 44 of the principal Order is amended by inserting, immediately after sub-paragraph (1), the following sub-paragraph:
(1A)  Notwithstanding sub-paragraph (1), if a Singapore aircraft to which this paragraph does not apply is provided with break-in markings, those markings shall be made in accordance with sub-paragraphs (5) and (7).”.
Amendment of Fifth Schedule
9.  The Fifth Schedule to the principal Order is amended —
(a)by deleting item 1 (page 86) in paragraph 4 and substituting the following item:

(b)by deleting item 5 (page 90) in paragraph 4 and substituting the following item:
“5.All aeroplanes having a maximum total weight authorised exceeding 5,700 kg. —
 
(a)for which a Certificate of Airworthiness in the Transport Category (Passenger) or the Transport Category (Cargo) has been issued; or

(b)in respect of which application has been made and not withdrawn or refused for such a certificate, and which fly under the “A Conditions” or under a Certificate of Airworthiness of the Special Category
P.”;

(c)by inserting, immediately after item 9 (page 91) in paragraph 4, the following item:
“10.Turbine-engine aeroplanes exceeding 5,700 kg. maximum total weight authorised or authorised to carry more than 9 passengers for the purpose of public transport

(d)by deleting paragraph (iv) (page 94) under Scale E in paragraph 5 and substituting the following paragraph:
(iv)A sensitive pressure altimeter adjustable for changes in barometric pressure.;”;
(e)by deleting paragraph (iv) (page 95) under Scale F in paragraph 5 and substituting the following paragraph:
(iv)A means of indicating the outside air temperature.;”
(f)by deleting paragraph (i) (page 95) under Scale G in paragraph 5 and substituting the following paragraph:
(i)At least one landing light, except that in the case of aircraft flying for the purpose of public transport, the landing light shall consist of 2 single filament lamps, or one dual filament lamp with separately energised filaments.”
(g)by inserting, immediately after paragraph (iii) (page 96) under Scale I in paragraph 5, the following paragraph:
(iv)Equipment for making the sound signals specified in the Merchant Shipping (Prevention of Collisions at Sea) Regulations (Cap. 179, Rg 10).”
(h)by inserting, immediately after Scale CC (page 112) in paragraph 5, the following Scale:
Scale DD.
A forward looking wind shear warning system capable of providing the pilot with —
(a)timely aural and visual warning of wind shear ahead of the aircraft;
(b)the information required to permit the pilot to safely commence and continue a missed approach or go-around or to execute an escape manoeuvre if necessary; and
(c)an indication that the limits specified for the certification of automatic landing equipment are being approached when such equipment is in use.”.
Amendment of Sixth Schedule
10.  The Sixth Schedule to the principal Order is amended —
(a)by deleting paragraph 2 and substituting the following paragraph:

Radio navigation equipment capable of receiving signals from one or more aeronautical radio stations on the surface to enable the aircraft to be guided to a point from which a visual landing can be made at the aerodrome at which the aircraft is to land.”;

Secondary surveillance radar equipment which includes a pressure altitude reporting transponder capable of operating in Mode A and Mode C and of being operated in accordance with such instructions as may be given to the aircraft by the appropriate air traffic control unit.
Scale H.
Airborne collision avoidance system (based on secondary surveillance radar transponder signals) which operates in accordance with the relevant provisions of Volume IV of Annex 10 to the Convention on International Civil Aviation and independently of ground based equipment and is designed to provide advice and appropriate avoidance manoeuvres to the pilot in relation to other aircraft which are equipped with secondary surveillance radar transponder when they are in undue proximity.
Scale I.
Navigation equipment capable of continuously providing indications to the flight crew of adherence to or departure from any track to the required degree of accuracy at any point along that track.
Scale J.
Navigation equipment which is capable of —
(a)indicating to the flight crew the flight level being flown;
(b)automatically maintaining a selected flight level; and
(c)providing an alert to the flight crew when a deviation occurs from the selected flight level, which alert shall have a threshold not exceeding 90 metres (300 feet).”;
(e)by inserting, immediately after paragraph 3, the following paragraph:
4.  In this Schedule —
“Mode A” means the mode in which equipment is capable of replying to an interrogation from secondary surveillance radar units on the surface to elicit transponder replies for identity and surveillance with identity provided in the form of a 4 digit identity code;
“Mode C” means the mode in which equipment is capable of replying to an interrogation from secondary surveillance radar units on the surface to elicit transponder replies for automatic pressure-altitude transmission and surveillance;
“secondary surveillance radar equipment” means such type of radio equipment as may be notified as being capable of —
(a)replying to an interrogation from secondary surveillance radar units on the surface; and
(b)being operated in accordance with such instructions as may be given to the aircraft by the appropriate air traffic control unit.”; and
(f)by inserting, immediately after the word “RADIO” in the heading, the words “AND RADIO NAVIGATION”.
Amendment of Ninth Schedule
11.  Part A of the Ninth Schedule to the principal Order is amended —
(a)by deleting the words “ICAO Annex 2” in paragraph 1(o) and substituting the words “Annex 2 to the Convention on International Civil Aviation”;
(b)by deleting the word “and” at the end of paragraph 1(x); and
(c)by deleting sub-paragraph (y) of paragraph (1) and substituting the following sub-paragraphs:
(y)policies, instructions and training requirements for the avoidance of collisions and procedures relating to the operation of any airborne collision avoidance system carried on the aircraft; and
(z)procedures, policies and instructions for the avoidance of controlled flight into terrain and the operation of any ground proximity warning system carried on the aircraft:”.
Amendment of Eleventh Schedule
12.  Paragraph 23 of the Eleventh Schedule to the principal Order is amended by inserting, immediately after sub-paragraph (c), the following sub-paragraph:
(d)Navigation shall be accomplished by visual reference to landmarks at least every 110 kilometres (60 nautical miles).”.
