(Sanctions — Haiti)
(Amendment) Regulations 2024
In exercise of the powers conferred by section 2(1) of the United Nations Act 2001, the Minister for Law makes the following Regulations:
Citation and commencement
1.  These Regulations are the United Nations (Sanctions — Haiti) (Amendment) Regulations 2024 and come into operation on 26 July 2024.
Amendment of regulation 2
2.  In the United Nations (Sanctions — Haiti) Regulations 2023 (G.N. No. S 630/2023) (called in these Regulations the principal Regulations), in regulation 2, replace “Resolution 2653 (2022)” with “Resolutions 2653 (2022), 2699 (2023) and 2700 (2023)”.
Amendment of regulation 4
3.  In the principal Regulations, in regulation 4(1) —
(a)delete the definition of “arms and related matériel”; and
(b)after the definition of “Committee”, insert —
“ “designated export item” means any item, material, equipment, goods or technology —
(a)that falls within the class or description specified in the third column of the Seventh Schedule to the Regulation of Imports and Exports Regulations (Rg 1), as in force on 26 July 2024, in relation to Haiti (specified in the first column of that Schedule); and
(b)the exportation from, transhipment in, or transit through, Singapore of which is prohibited under regulation 6(2)(c)(ii) of the Regulation of Imports and Exports Regulations in relation to Haiti;”.
Amendment of regulation 7
4.  In the principal Regulations, in regulation 7 —
(a)in the regulation heading, replace “arms and related matériel” with “designated export item”; and
(b)replace “arms and related matériel to or for the benefit of a designated person” with “any designated export item to any person in Haiti”.
Amendment of regulation 8
5.  In the principal Regulations, in regulation 8 —
(a)in the regulation heading, replace “arms and related matériel” with “designated export item”; and
(b)replace “any arms and related matériel for supply, sale or transfer to or for the benefit of any designated person” with “any designated export item for supply, sale or transfer to any person in Haiti”.
Amendment of regulation 9
6.  In the principal Regulations, in regulation 9 —
(a)in paragraph (a)(ii), replace “arms and related matériel” with “designated export item”; and
(b)replace “to or for the benefit of a designated person” with “to any person in Haiti”.
New regulation 11A
7.  In the principal Regulations, after regulation 11, insert —
Power to investigate
11A.  Any person designated by the Minister for the purposes of this regulation may investigate into any offence under these Regulations and, when investigating that offence, may exercise all the powers of a police officer under the Criminal Procedure Code 2010 in relation to arrestable offences.”.
Amendment of regulation 15
8.  In the principal Regulations, in regulation 15 —
(a)renumber the regulation as paragraph (1) of that regulation; and
(b)after paragraph (1), insert —
(2)  The Minister or a person designated by the Minister may, if he or she considers that it is appropriate to do so in the circumstances of the case and that it is consistent with the intention of the United Nations Security Council under paragraph 14 of Resolution 2699 (2023), by written notice exempt, subject to any conditions that he or she may specify —
(a)any person or class of persons; or
(b)any activity or class of activities,
from regulation 7, 8 or 9.”.
