Executive Condominium Housing Scheme Act

Executive Condominium Housing Scheme (Amendment) Regulations 2000
In exercise of the powers conferred by section 3(2) of the Executive Condominium Housing Scheme Act, the Minister for National Development hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Executive Condominium Housing Scheme (Amendment) Regulations 2000 and shall come into operation on 5th January 2000.
Amendment of Schedule
2.  Form B in the Schedule to the Executive Condominium Housing Scheme Regulations (Rg 1) is amended by inserting, immediately after clause 23, the following clause:
23A.  Mediation
23A.—(1)  The Vendor and Purchaser agree that before they refer any dispute or difference relating to this Agreement to arbitration or court proceedings, they shall consider resolving the dispute or difference through mediation at the Singapore Mediation Centre in accordance with its prevailing prescribed forms, rules and procedures.
23A.(2)  For the avoidance of doubt, this clause shall not amount to a legal obligation on the part of either the Vendor or Purchaser to attempt mediation as a means of resolving their dispute or difference.”.
Transitional provision
3.  Where a purchaser of any housing accommodation in an executive condominium scheme under an agreement made before 5th January 2000 assigns, on or after that date, all his right, title or interest under that agreement, the new agreement with the assignee for the sale and purchase of that housing accommodation shall be in the form prescribed by the Executive Condominium Housing Scheme Regulations as amended by these Regulations.
