Merchant Shipping Act 1995

Merchant Shipping (Prevention of Collisions At Sea) (Amendment) Regulations 1996
In exercise of the powers conferred by sections 100 and 216 of the Merchant Shipping Act 1995, the Minister for Communications hereby makes the following Regulations:
1.  These Regulations may be cited as the Merchant Shipping (Prevention of Collisions at Sea) (Amendment) Regulations 1996 and shall come into operation on 2nd February 1996.
2.  The Merchant Shipping (Prevention of Collisions at Sea) Regulations are amended by inserting, immediately after regulation 3, the following regulation:
Offence
4.—(1)  Where any of these Regulations is contravened, the owner of the vessel, the master and any person for the time being responsible for the conduct of the vessel shall each be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
(2)  It shall be a defence for any person charged with an offence under these Regulations to show that he took all reasonable precautions to avoid the commission of the offence.

3.  Section 13 of Annex I of the International Regulations for Preventing Collisions at Sea 1972 as set out in the Schedule to the Merchant Shipping (Prevention of Collisions at Sea) Regulations is amended by deleting the word “and” at the end of the seventh line and substituting the word “end”.
