Central Provident Fund Act
(Chapter 36)
Central Provident Fund (Medishield Scheme) (Amendment No. 4) Regulations 2010
In exercise of the powers conferred by section 57 of the Central Provident Fund Act, the Minister for Manpower hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Central Provident Fund (MediShield Scheme) (Amendment No. 4) Regulations 2010 and shall come into operation on 1st November 2010.
Deletion and substitution of regulation 3
2.  Regulation 3 of the Central Provident Fund (MediShield Scheme) Regulations (Rg 20) (referred to in these Regulations as the principal Regulations) is deleted and the following regulation substituted therefor:
Persons who are not entitled to join Scheme
3.—(1)  Except as expressly provided otherwise in these Regulations, a person shall not be entitled to join the Scheme, if —
(a)he has attained the age of 85 years;
(b)he is neither a citizen nor a permanent resident of Singapore;
(c)the Board is satisfied that he is incapacitated;
(d)the Board is satisfied that he lacks capacity within the meaning of section 4 of the Mental Capacity Act (Cap. 177A); or
(e)the Board is satisfied that he is suffering from a terminal illness or disease.
(2)  Notwithstanding paragraph (1), the Board may permit a person to whom paragraph (1)(c) or (d) applies to join the Scheme subject to such terms and conditions as the Board may impose.”.
Amendment of regulation 6
3.  Regulation 6(1) of the principal Regulations is amended —
(a)by deleting the words “any other provision of this regulation or regulation 7(2)” in sub-paragraphs (f)(iii), (g)(iii) and (h)(iii) and substituting in each case the words “this regulation or regulation 7”;
(b)by deleting the word “and” at the end of sub-paragraph (g); and
(c)by deleting the comma at the end of sub-paragraph (h) and substituting the word “; and”, and by inserting immediately thereafter the following sub-paragraph:
(i)any person —
(i)who has not attained the age of 21 years as at 30th June 2010;
(ii)whose parent or parents (and recognised by the Board as such) is or are members;
(iii)who —
(A)becomes a citizen of Singapore when below 21 years of age —
(AA)by descent on registration of his birth before 1st December 2007; or
(AB)by birth or registration, before that same date; or
(B)being born in Singapore, becomes a permanent resident of Singapore before 1st December 2007; and
(iv)who, being earlier covered, or offered cover, under the Scheme pursuant to this regulation or regulation 7, has not had such cover terminated under regulation 22 or 23, whether by himself or any other person,”.
Amendment of regulation 8
4.  Regulation 8 of the principal Regulations is amended by deleting the words “(g) or (h)” in paragraphs (9), (11), (12), (12A), (12B)(a) and (12C) and substituting in each case the words “(g), (h) or (i)”.
Amendment of regulation 9
5.  Regulation 9(1) of the principal Regulations is amended by deleting the words “(g) or (h)” in sub-paragraph (b) and substituting the words “(g), (h) or (i)”.
Amendment of regulation 16
6.  Regulation 16(1) of the principal Regulations is amended by deleting sub-paragraph (a) and substituting the following sub-paragraph:
(a)the Board has reason to believe that —
(i)any insured person is incapacitated, or is suffering from a terminal illness or disease, before the date of his joining the Scheme in Division 2 of Part II; or
(ii)any insured person lacks capacity within the meaning of section 4 of the Mental Capacity Act (Cap. 177A), and his lack of capacity is likely to be permanent, before the date of his joining the Scheme in Division 2 of Part II;”.
Amendment of regulation 19
7.  Regulation 19(1) of the principal Regulations is amended by deleting sub-paragraph (c) and substituting the following sub-paragraph:
(c)the Board —
(i)is satisfied that the insured person is incapacitated, or lacks capacity within the meaning of section 4 of the Mental Capacity Act (Cap. 177A), or is suffering from a terminal illness or disease, on or before the date of the commencement of his insurance cover under the Scheme in Division 2 or 3, as the case may be, of Part II; and
(ii)does not permit him to join the Scheme under regulation 3(2); or”.
Amendment of regulation 21
8.  Regulation 21 of the principal Regulations is amended by inserting, immediately after paragraph (1), the following paragraph:
(1A)  The insurance cover of an insured person shall not be renewed on or after the date he attains the age of 85 years.”.
Amendment of regulation 23
9.  Regulation 23(2) of the principal Regulations is amended by deleting the words “2008 (Act 22 of 2008)” in sub-paragraph (b) and substituting “(Cap. 177A)”.
Amendment of regulation 25
10.  Regulation 25 of the principal Regulations is amended by deleting paragraph (4) and substituting the following paragraph:
(4)  Notwithstanding regulation 3(1) —
(a)where the Board has terminated a person’s insurance cover under paragraph (3), the Board may, on the application of the person, permit the person to rejoin the Scheme, and reinstate the person’s insurance cover under the Scheme, subject to such terms and conditions as the Board may impose; and
(b)where the Board has permitted a person to rejoin the Scheme under sub-paragraph (a), these Regulations shall apply to the person, from the date he rejoins the Scheme, as if the Board had not terminated his insurance cover under paragraph (3).”.
