Planning (Use Classes) (Amendment) Rules 2004

In exercise of the powers conferred by section 61 of the Planning Act, the Minister for National Development hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Planning (Use Classes) (Amendment) Rules 2004 and shall come into operation on 28th October 2004.

Amendment of rule 2

2. Rule 2 of the Planning (Use Classes) Rules (R 2) is amended —

(a)

by inserting, immediately after the definition of “building”, the following definition:

“ “business zone retail” means the retail of goods or foodstuff —

(a)	in an industrial retail building, where such goods or foodstuff, as the case may be, are also manufactured or packed; or
(b)	in a warehouse retail building, where such goods or foodstuff, as the case may be, are also stored;”;

(b)

by inserting, immediately after the word “laundry” in the definition of “industrial building”, the words “or an industrial retail building”;

(c)

by inserting, immediately after the definition of “industrial building”, the following definition:

“ “industrial retail building” means any building used for the manufacturing or packing of goods or foodstuff and the retail of such goods or foodstuff, as the case may be;”;

(d)

by deleting the word “or” at the end of paragraph (i) of the definition of “shop”;

(e)

by inserting, at the end of paragraph (ii) of the definition of “shop”, the word “or”, and by inserting immediately thereafter the following paragraph:

“(iii)

any part of an industrial retail building or a warehouse retail building used for business zone retail;”;

(f)

by inserting, immediately after the words “such storage” in the definition of “warehouse”, the words “, but does not include a warehouse retail building”; and

(g)

by deleting the full-stop at the end of the definition of “warehouse” and substituting a semi-colon, and by inserting immediately thereafter the following definition:

“ “warehouse retail building” means any building used for the storage of goods or foodstuff and the retail of such goods or foodstuff, as the case may be.”.
