Electricity (Contestable Consumers) Regulations 2002

In exercise of the powers conferred by section 41(1) of the Electricity Act, the Energy Market Authority of Singapore, with the approval of Mr Khaw Boon Wan, Senior Minister of State, Ministry of Transport and Ministry of Information, Communications and the Arts, charged with the responsibility of the Minister for Trade and Industry, hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Electricity (Contestable Consumers) Regulations 2002 and shall come into operation on 1st January 2003.

Definitions

2. In these Regulations, unless the context otherwise requires —

“master-meter” means a meter measuring the electricity consumed by all the units and common areas in a building or cluster of buildings which are used or occupied by multiple consumers;

“sub-meter” means a meter measuring the electricity which, after being taken through a master-meter, is consumed by a unit in a building or cluster of buildings.

Contestable consumers

3. Subject to regulation 4, a consumer shall, with effect from 1st January 2003, be classified as a contestable consumer in respect of premises used or occupied by him at a single location if —

(a)

the consumer is not using or occupying those premises for a residential purpose; and

(b)

in respect of those premises, the consumer —

(i)	required, on 1st October 2002, electricity to be supplied at high voltage where the maximum power to be made available to the consumer equals to or exceeds 2 megawatts; or
(ii)	is, on 1st January 2003, purchasing electricity under a contract with a retail electricity licensee.

Consumers not qualifying to be classified as contestable consumers

4. Unless the Authority otherwise determines, no consumer shall be classified as a contestable consumer under these Regulations in respect of premises used or occupied by him at a single location if —

(a)	the premises form part of a building or cluster of buildings used or occupied by multiple consumers; and
(b)	the consumption of electricity in that building or cluster of buildings is metered by a master-meter and sub-meters.
