(Minor Gambling — Class Licence)
Order 2022
In exercise of the powers conferred by section 60 of the Gambling Control Act 2022, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.  This Order is the Gambling Control (Minor Gambling — Class Licence) Order 2022 and comes into operation on 1 February 2023.
Definitions
2.  In this Order, unless the context otherwise requires —
“arts entertainment” means any, or any combination, of the following:
(a)a play, opera, pantomime, puppet show or tableaux;
(b)a play-reading, poetry-reading or recital;
(c)a performance of music, singing or dancing;
(d)a display or an exhibition of models, reading matter, pictures, photographs, statuary or still objects or art generally;
(e)a performance of a circus act or a variety act or any similar presentation or show;
(f)a display or an exhibition using real‑time transmission of the performance, display or exhibition happening elsewhere (whether in or outside Singapore and whether in a public or private place) of any item, or any combination of the items, specified in paragraphs (a) to (e);
“business event” means a lecture, talk, conference, convention, meeting (statutorily required or otherwise) or a combination thereof —
(a)that is arranged or held, in the course of business, to discuss or negotiate matters relating wholly or mainly to —
(i)trade, manufacturing or commerce (but not anything connected with the gambling industry or with problem gambling);
(ii)finance, industry or economics;
(iii)professional practice or matters, health, arts, science or technology; or
(iv)industrial relations, security or international affairs, the environment or any other cause or matter, whether or not of a similar kind; and
(b)to which individuals are admitted on payment of a fee or charge, on the basis of their membership of an organisation, or after making a contribution or admitted free of charge, to attend the meeting or to enter or remain at the venue where a business event takes place, or is to take place,
but does not include a gathering arranged or held, in the course of business —
(c)to temporarily exhibit or display goods of any kind for the purposes of sale or supply to a consumer or otherwise; or
(d)to promote the trading of goods or the provision of services to a consumer or otherwise;
“class licensee” means a person to whom a class licence by virtue of this Order applies but does not include a person for the time the application of that class licence is suspended or disapplied under the Act;
“defined game of chance” means any game, method, device, scheme or competition —
(a)that —
(i)involves both an element of chance and an element of skill;
(ii)involves an element of chance that can be eliminated by superlative skill; or
(iii)is presented as involving an element of chance;
(b)that is not a game played with a gaming machine but may be a game played (in whole or in part) using remote communication; and
(c)that does not involve the use of, and does not comprise any design element or game mechanic from or involving, any game, method, device, scheme or competition which is specified in the First Schedule or any variant of such a specified game, method, device, scheme or competition;
“defined lottery” means any lottery, whether or not using any remote communication to participate in, but excludes any lottery that does involve the use of, or does comprise any design element or game mechanic from or involving —
(a)any game, method, device, scheme or competition which is specified in the First Schedule; or
(b)any variant of such a specified game, method, device, scheme or competition;
“engage in defined gambling” means —
(a)to play a defined game of chance; or
(b)to participate in a defined lottery,
with or without, and wholly or in part, using any remote communication;
“non-gambling event” means any of the following that does not have any gambling as its main or primary object:
(a)any type of private social function at which a group of individuals come together to associate or interact with each other for social purposes, such as a nuptial event, birthday celebration, wedding anniversary celebration or a dinner and dance;
(b)a business event the main object of which is neither gambling nor the provision of a gambling service;
(c)a live performance of arts entertainment by performers in a place in the presence of an audience in the same place;
(d)any ceremony or rite or celebration lawfully conducted by priests or ministers of religion outside of any place of worship or premises consecrated or dedicated generally or specifically for the conduct of religious services;
(e)a sporting event;
“nuptial event” means —
(a)a solemnisation of a marriage; or
(b)a wedding;
“participant”, for a non-gambling event, means as follows:
(a)for a nuptial event or other private social function — any guest invited to attend the nuptial event or other private social function;
(b)for a live performance of any arts entertainment — any audience member;
(c)for a business event — an individual who is entitled to be admitted to a place where the business event takes place, or is to take place, for any of the following purposes:
(i)to attend, watch, vote or take part in any other way, in the lecture, talk, conference, convention, meeting staged or conducted, or to be staged or conducted, in that place;
(ii)to preside at, speak or otherwise take charge of proceedings in, or to regulate the number and length of, any lecture, talk or meeting staged or conducted, or to be staged or conducted, at the business event;
(d)for a ceremony, rite or celebration lawfully conducted by priests or ministers of religion outside of any place of worship or premises consecrated or dedicated generally or specifically for the conduct of religious services — a worshipper attending the ceremony, rite or celebration;
(e)for a sporting event involving any sporting activity — either or both the following:
(i)a spectator attending to view the playing of the sporting activity at the sporting event;
(ii)an athlete or a contestant engaging in or playing the sporting activity at the sporting event;
“religious service” means a ceremony or rite, or an observance or a worship, sermon or service, based wholly on a religious belief, religious opinion or religious affiliation;
“sporting event” means an event arranged in the course of business, comprising a type of match, game, competition, display or exhibition of any sporting activity, or a series of matches, games, competitions, displays or exhibitions of any sporting activity, involving the engaging in or playing of one or more sporting activities at a sports venue —
(a)to which mainly athletes or contestants are admitted to take part in the sporting activity at the sports venue; or
(b)to which spectators are admitted on payment of a fee or charge or after making a donation, or admitted free of charge, to view the playing of the sporting activity at the sports venue,
but excludes taking part in a sporting activity during the conduct of any lesson, coaching or instruction of the sporting activity provided by a person carrying on an education business;
“sports venue” means any purpose‑built sports facility (like a stadium, court or swimming pool) for engaging in or playing a sporting activity, and includes an open space, an area of open water or a waterway or a road or path used for a sporting event.
Class licence for incidental gambling
3.—(1)  Unless exempt under section 128 of the Act, every person who provides a gambling service by conducting gaming involving a defined game of chance, or by conducting a defined lottery, as follows is subject to a class licence in connection with the provision of such a gambling service:
(a)at any time on or after 1 February 2023 at any place in Singapore;
(b)in the course of the conduct (by the person or another) of a non‑gambling event at that place in Singapore;
(c)as a form of entertainment or amusement for participants attending (in person or otherwise) the non‑gambling event;
(d)in which only participants attending (in person or otherwise) the non‑gambling event have a right to engage in defined gambling involving the defined game of chance or the defined lottery;
(e)where to engage, or engaging, in any defined gambling involving the defined game of chance or the defined lottery does not depend on the payment of any money or money equivalent other than payment of an entrance fee or other fee to attend the non-gambling event.
(2)  However, this paragraph does not apply to the provision of any gambling service covered by a class licence under —
(a)the Gambling Control (Trade and Other Promotional Games and Lotteries — Class Licence) Order 2022 (G.N. No. S 660/2022); or
(b)the Gambling Control (Fundraisers — Class Licence) Order 2022 (G.N. No. S 661/2022).
Conditions of class licence for incidental gambling
4.  A class licensee by virtue of this Order is authorised to conduct gaming involving a defined game of chance or a defined lottery in connection with a non‑gambling event, subject to the class licensee taking all reasonably practicable steps to satisfy the following conditions:
(a)any information or material which gives publicity to, or otherwise promotes or is intended to promote the non‑gambling event —
(i)must not exaggerate the connection between the defined game of chance or defined lottery and the non‑gambling event so as to appear, to a reasonable observer, to be the primary inducement to attend the non‑gambling event; and
(ii)must not display any image of a gambling article specified in the Second Schedule when describing or referring to the defined game of chance or defined lottery;
(b)no image of a gambling article specified in the Second Schedule is displayed or used at any time during the conduct of the defined game of chance or the defined lottery;
(c)the determination of the winners for the prizes in the defined game of chance or defined lottery (as the case may be) takes place at the place, and either at or before the date or time, of the non‑gambling event in accordance with the publicity for the non‑gambling event;
(d)after the winner or winners of the defined game of chance or defined lottery is or are determined —
(i)to advise each prize‑winner (within 7 days after the determination of the winners) of the prize that the prize‑winner has won and how to claim it; or
(ii)to ensure that particulars of the results of the game of chance or lottery draw (as the case may be) are published —
(A)within 7 days after the determination of the winners, in a newspaper or other publication (such as a magazine) circulating generally throughout Singapore; or
(B)for a period of at least 2 months on the Internet website of the class licensee, if any.
