Active Mobility
(Cycling Without Age —
Exemption) Order 2022
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Cycling Without Age — Exemption) Order 2022.
(2)  This Order is in force on 6 August 2022 and 7 August 2022.
Definitions
2.  In this Order —
“CWA Singapore” means the company incorporated under the Companies Act 1967 as Cycling Without Age Singapore Ltd. (UEN 201714757N);
“specified event” means the Sport Festival event as part of GetActive! Singapore National Day Celebration organised by Sports Singapore on the following dates from 8 a.m. to 12 noon each day:
(a)6 August 2022;
(b)7 August 2022;
“specified e-trishaw” means a three-wheeled pedal cycle that —
(a)is constructed or adapted for the carriage of passengers;
(b)is equipped with an electric motor;
(c)may be propelled by human power or by the electric motor with which it is equipped, or by both; and
(d)is used by CWA Singapore for the purpose of ferrying individuals;
“specified shared path” means the part of the shared path specified in item 94 of the Third Schedule to the Active Mobility (Shared Paths) Order 2018 (G.N. No. S 260/2018), as delineated by the black‑coloured lines in the map set out in the Schedule.
Exemption for driving specified e-trishaw
3.  Section 17(1) of the Act does not apply to an individual who drives a specified e‑trishaw on a specified shared path under the following conditions:
(a)the individual has completed a training course conducted by CWA Singapore on how to drive the specified e‑trishaw;
(b)the individual is authorised by CWA Singapore to drive the specified e‑trishaw on the specified shared path in connection with the specified event;
(c)the specified e-trishaw is only used to carry, for their leisure, passengers who belong to any class of passengers that is approved by the Authority to be carried on a specified e‑trishaw;
(d)the specified e-trishaw is not used to carry passengers for hire or reward;
(e)the individual who drives the specified e-trishaw —
(i)drives at a speed not exceeding 10 km/h;
(ii)does not carry more passengers than the specified e‑trishaw is designed to carry;
(iii)drives with all passengers on the specified e‑trishaw safely secured;
(iv)gives way to other users of the specified shared path; and
(v)keeps a distance of at least 100 metres away from any other specified e-trishaw;
(f)the specified e-trishaw is accompanied by a safety marshal who ensures the safe use of the specified e-trishaw;
(g)there is in force, at any time the specified e-trishaw is used in connection with the specified event, a policy of insurance in relation to the specified e‑trishaw insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (other than the driver or any passenger of the specified e‑trishaw); and
(ii)any property damage suffered by any person (other than the driver or any passenger of the specified e‑trishaw),
caused by or arising out of the use of the specified e‑trishaw;
(h)the risk under the policy of insurance mentioned in sub‑paragraph (g) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore;
(i)no more than 3 specified e-trishaws are to be used at any time on the specified shared path.
