Employment of Foreign Manpower (Levy)
(Amendment No. 2)
Order 2012

In exercise of the powers conferred by section 11(1) and (5) of the Employment of Foreign Manpower Act, Mr Tan Chuan-Jin, Senior Minister of State, charged with the responsibility of the Minister for Manpower, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Employment of Foreign Manpower (Levy) (Amendment No. 2) Order 2012 and shall come into operation on 1st January 2013.

New paragraph 5A

2. The Employment of Foreign Manpower (Levy) Order 2011 (G.N. No. S 371/2011) (referred to in this Order as the principal Order) is amended by inserting, immediately after paragraph 5, the following paragraph:

“Levy penalty

5A. The penalty under section 11(4) of the Act for any unpaid levy shall be the greater of the following sums:

(a)	the sum calculated at the rate of 2% per month on the amount of levy outstanding;
(b)	the sum of $20.”.

Amendment of Fourth Schedule

3. The Fourth Schedule to the principal Order is amended —

(a)	by deleting “$200” in the fourth column of item 1 and substituting “$250”; and
(b)	by deleting “$320” in the fourth column of item 2 and substituting “$390”.

Amendment of Fifth Schedule

4. The Fifth Schedule to the principal Order is amended —

(a)	by deleting “$340” in the fourth column of item 1 and substituting “$370”;
(b)	by deleting “$240” in the fifth column of item 1 and substituting “$270”;
(c)	by deleting “$460” in the fourth column of item 2 and substituting “$480”;
(d)	by deleting “$360” in the fifth column of item 2 and substituting “$380”;
(e)	by deleting “$500” in the fourth column of item 3 and substituting “$550”; and
(f)	by deleting “$500” in the fifth column of item 3 and substituting “$550”.

Amendment of Sixth Schedule

5. The Sixth Schedule to the principal Order is amended —

(a)	by deleting “$350” in the second column of item 1 and substituting “$370”;
(b)	by deleting “$460” in the second column of item 2 and substituting “$480”; and
(c)	by deleting “$500” in the second column of item 3 and substituting “$550”.

Amendment of Seventh Schedule

6. The Seventh Schedule to the principal Order is amended —

(a)

by deleting “$250” in the second column of item 1 and substituting “$280”;

(b)

by deleting “$350” in the second column of item 2 and substituting “$400”;

(c)

by deleting “$500” in the second column of item 3 and substituting “$650”; and

(d)

by deleting item 4 and substituting the following items:

“

4.	Higher skilled construction worker excluded from the requirement for prior authorisation before applying for a work permit

$550

5.	Basic skilled construction worker excluded from the requirement for prior authorisation before applying for a work permit

$650.

”.

Amendment of Eighth Schedule

7. The Eighth Schedule to the principal Order is amended —

(a)	by deleting “$210” in the second column of item 1 and substituting “$230”; and
(b)	by deleting “$310” in the second column of item 2 and substituting “$330”.

Amendment of Ninth Schedule

8. The Ninth Schedule to the principal Order is amended —

(a)	by deleting “$310” in the fourth column of item 1 and substituting “$330”;
(b)	by deleting “$210” in the fifth column of item 1 and substituting “$230”;
(c)	by deleting “$400” in the fourth column of item 2 and substituting “$430”;
(d)	by deleting “$300” in the fifth column of item 2 and substituting “$330”;
(e)	by deleting “$470” in the fourth column of item 3 and substituting “$500”; and
(f)	by deleting “$470” in the fifth column of item 3 and substituting “$500”.

Amendment of Tenth Schedule

9. The Tenth Schedule to the principal Order is amended —

(a)	by deleting “$240” in the second column of item 1 and substituting “$270”; and
(b)	by deleting “$340” in the second column of item 2 and substituting “$370”.

Amendment of Eleventh Schedule

10. The Eleventh Schedule to the principal Order is amended —

(a)	by deleting “$210” in the second column of item 1 and substituting “$230”;
(b)	by deleting “$310” in the second column of item 2 and substituting “$330”; and
(c)	by deleting “$470” in the second column of item 3 and substituting “$500”.

Amendment of Twelfth Schedule

11. The Twelfth Schedule to the principal Order is amended —

(a)	by deleting “$210” in the second column of item 1 and substituting “$230”;
(b)	by deleting “$310” in the second column of item 2 and substituting “$330”; and
(c)	by deleting “$470” in the second column of item 3 and substituting “$500”.

Revocation

12. The Employment of Foreign Manpower (Levy Penalty) Order 2012 (G.N. No. S 568/2012) is revoked.

Transitional and savings provisions

13.—(1) For the avoidance of doubt, this Order applies to the levy payable in respect of the month of January 2013 or any month thereafter, or part thereof, by every employer in respect of the following persons:

(a)	any S pass holder whose S pass is issued, or who starts lawful employment with that employer, whether before, on or after 1st January 2013; and
(b)	any work permit holder whose work permit is issued, or who starts lawful employment with that employer, whether before, on or after 1st January 2013.

(2) The principal Order in force immediately before 1st January 2013 shall continue to apply with respect to a levy payable by any employer for any month or part thereof before that date under that Order.
