(Chye Thiam Maintenance Pte Ltd — Exemption)
Order 2021
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Chye Thiam Maintenance Pte Ltd — Exemption) Order 2021.
(2)  This Order is in force for the period between 10 September 2021 and 9 November 2021 (both dates inclusive).
Definitions
2.  In this Order —
“Chye Thiam Maintenance” means the company incorporated under the Companies Act (Cap. 50) as Chye Thiam Maintenance Pte Ltd (UEN 198801700E);
“specified e‑tricycle” means a three‑wheeled pedal cycle that —
(a)is constructed or adapted for the carriage of goods;
(b)is equipped with an electric motor; and
(c)may be propelled by human power or by the electric motor with which it is equipped, or by both;
“specified footpath” means any of the footpaths delineated by the black‑coloured lines in the map set out in Part 1 of the Schedule;
“specified shared path” means the shared path specified in Part 2 of the Schedule;
“trial” means the trial conducted daily by Chye Thiam Maintenance on any specified footpath or specified shared path between 10 September 2021 and 9 November 2021 (both dates inclusive).
Exemption for driving specified e‑tricycle
3.  Sections 16(1)(b) and 17(1) of the Act do not apply to an individual who drives a specified e‑tricycle (called in this paragraph a driver) on a specified footpath or specified shared path during and in connection with the trial, under the following conditions:
(a)Chye Thiam Maintenance uses the specified e‑tricycle only to collect or transport waste;
(b)the driver is authorised by Chye Thiam Maintenance to drive the specified e‑tricycle;
(c)the driver, when driving the specified e‑tricycle —
(i)gives way to other users of the specified footpath or specified shared path; and
(ii)drives at a speed not exceeding 10 km/h;
(d)the specified e‑tricycle does not carry, at any time, any person other than the driver;
(e)only one specified e‑tricycle is used on any specified footpath or specified shared path at any time;
(f)there is in force, at any time the specified e‑tricycle is used in connection with the trial, a policy of insurance in relation to the specified e‑tricycle insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (other than the driver); or
(ii)property damage suffered by any person (other than the driver),
caused by or arising out of the use of the specified e‑tricycle;
(g)the risk under the policy of insurance mentioned in sub‑paragraph (f) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore.
