Employment of Foreign Manpower
(Levy) (Amendment)
Order 2011

In exercise of the powers conferred by section 11(1) of the Employment of Foreign Manpower Act, the Minister for Manpower hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Employment of Foreign Manpower (Levy) (Amendment) Order 2011 and shall come into operation on 1st January 2012.

Amendment of paragraph 2

2. Paragraph 2 of the Employment of Foreign Manpower (Levy) Order 2011 (G.N. No. S 371/2011) (referred to in this Order as the principal Order) is amended by inserting, immediately after the definition of “ordering day”, the following definition:

“ “performing artiste” means a work permit holder who is employed to perform as an artiste in an establishment for which a CAT 1 Public Entertainment Establishment Licence has been issued under the Public Entertainments and Meetings Act (Cap. 257);”.

New Division 11

3. The principal Order is amended by inserting, immediately after paragraph 31, the following Division:

“Division 11 — Performing artistes

Levy payable by employer of performing artistes

31A. The levy payable by the employer for a month in respect of a performing artiste of his shall be the amount of levy specified in the fourth column of the Fifth Schedule corresponding to Tier 1.”.

Deletion of paragraph 33

4. Paragraph 33 of the principal Order is deleted.

Amendment of Second Schedule

5. The Second Schedule to the principal Order is amended —

(a)	by deleting the semi-colon at the end of paragraph 3(b) and substituting a full-stop; and
(b)	by deleting paragraph 3(c).

Amendment of Fourth Schedule

6. The Fourth Schedule to the principal Order is amended —

(a)	by deleting “$120” in the fourth column of item 1 and substituting “$160”; and
(b)	by deleting “$180” in the fourth column of item 2 and substituting “$250”.

Amendment of Fifth Schedule

7. The Fifth Schedule to the principal Order is amended —

(a)

by deleting “$280” in the fourth column of item 1 and substituting “$310”;

(b)

by deleting “$180” in the fifth column of item 1 and substituting “$210”;

(c)

by deleting “35%” in the second column of item 2 and substituting “30%”;

(d)

by deleting “35” in the third column of item 2 and substituting “30”;

(e)

by deleting “$400” in the fourth column of item 2 and substituting “$430”;

(f)

by deleting “$300” in the fifth column of item 2 and substituting “$330”;

(g)

by deleting “35%” in the second column of item 3 and substituting “30%”;

(h)

by deleting “$450” in the fourth column of item 3 and substituting “$470”;

(i)

by deleting “$450” in the fifth column of item 3 and substituting “$470”; and

(j)

by deleting the Schedule reference and substituting the following Schedule reference:

“Paragraphs 2, 12, 13, 15 and 31A”.

Amendment of Sixth Schedule

8. The Sixth Schedule to the principal Order is amended —

(a)	by deleting “$400” in the second column of item 2 and substituting “$430”; and
(b)	by deleting “$450” in the second column of item 3 and substituting “$470”.

Amendment of Seventh Schedule

9. The Seventh Schedule to the principal Order is amended —

(a)	by deleting “$180” in the second column of item 1 and substituting “$200”;
(b)	by deleting “$230” in the second column of item 2 and substituting “$300”;
(c)	by deleting “$380” in the second column of item 3 and substituting “$450”; and
(d)	by deleting “$380” in the second column of item 4 and substituting “$450”.

Amendment of Eighth Schedule

10. The Eighth Schedule to the principal Order is amended by deleting “$180” in the second column of item 1 and substituting “$190”.

Amendment of Ninth Schedule

11. The Ninth Schedule to the principal Order is amended —

(a)	by deleting “$280” in the fourth column of item 1 and substituting “$290”;
(b)	by deleting “$180” in the fifth column of item 1 and substituting “$190”;
(c)	by deleting “$340” in the fourth column of item 2 and substituting “$370”; and
(d)	by deleting “$240” in the fifth column of item 2 and substituting “$270”.

Amendment of Tenth Schedule

12. The Tenth Schedule to the principal Order is amended —

(a)	by deleting “$180” in the second column of item 1 and substituting “$210”; and
(b)	by deleting “$280” in the second column of item 2 and substituting “$310”.

Transitional and savings provisions

13.—(1) This Order applies to the levy payable in respect of January 2012 or any month thereafter, or part thereof, by every employer in respect of any S pass holder or work permit holder whose S pass or work permit is issued, or who starts lawful employment with that employer, whether before, on or after 1st January 2012.

(2) The principal Order in force immediately before 1st January 2012 shall continue to apply to a levy in respect of any month or part thereof before that date imposed on an employer under that Order.
