(Amendment) Rules 2024

In exercise of the powers conferred by section 82 of the Town Councils Act 1988, the Minister for National Development makes the following Rules:

Citation and commencement

1.—(1) These Rules are the Town Councils (Exclusion of Property from Definition of Common Property) (Amendment) Rules 2024 and, except for rule 4, come into operation on 16 September 2024.

(2) Rule 4 is deemed to have come into operation on 31 December 2021.

Amendment of rule 2

2. In the Town Councils (Exclusion of Property from Definition of Common Property) Rules 2017 (G.N. No. S 557/2017) (called in these Rules the principal Rules), in rule 2, after the definition of “building”, insert —

“ “communal space”, for a building comprising Community Care Apartments, means any space in the building that is demarcated by the Board for communal use;

“Community Care Apartments” means the category of flats sold subject to Part 4 of the Housing and Development Act 1959 with the provision of care services and social activities to residents of each flat;”.

Amendment of rule 3

3. In the principal Rules, in rule 3 —

(a)

in paragraph (a), delete “and” at the end;

(b)

in paragraph (b), replace the full‑stop at the end with “; and”; and

(c)

after paragraph (b), insert —

“(c)	any communal space in a building comprising Community Care Apartments.”.

Miscellaneous amendments

4. In the principal Rules —

(a)	in rule 2, in the definition of “building”, replace “(Cap. 29)” with “1989”;
(b)	in rule 2, in the definition of “housing estate under construction”, in paragraph (a), after “Building Control Act”, insert “1989”;
(c)	in rule 2, in the definition of “temporary occupation permit”, in paragraph (a), after “Building Control Act”, insert “1989”; and
(d)	in rule 3, replace “paragraph (v)” with “paragraph (n)”.
