Environmental Public Health Act
(Chapter 95)
Environmental Public Health (Cemeteries) (Amendment) Regulations 2006
In exercise of the powers conferred by section 111 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Environmental Public Health (Cemeteries) (Amendment) Regulations 2006 and shall come into operation on 1st January 2007.
Amendment of regulation 2
2.  Regulation 2 of the Environmental Public Health (Cemeteries) Regulations (Rg 9) (referred to in these Regulations as the principal Regulations) is amended ––
(a)by deleting the word “Government” in the definition of “cemetery” and substituting the word “Agency”;
(b)by deleting the semi-colon at the end of the definition of “owner of a private cemetery” and substituting a full-stop; and
(c)by deleting the definition of “public health officer”.
Amendment of regulation 7
3.  Regulation 7 of the principal Regulations is amended by inserting, immediately after the word “ground”, the words “except with the written permission of the Director-General”.
Amendment of regulation 10
4.  Regulation 10 of the principal Regulations is amended —
(a)by deleting the words “Government cemetery” and substituting the words “cemetery maintained by the Agency”; and
(b)by deleting the regulation heading and substituting the following regulation heading:
Rules for cemetery maintained by Agency”.
Amendment of regulation 12
5.  Regulation 12 of the principal Regulations is amended ––
(a)by deleting the word “Commissioner” in paragraph (1) and substituting the word “Agency”; and
(b)by deleting paragraph (2) and substituting the following paragraph:
(2)  The Agency may ––
(a)with the approval of the Minister, waive the payment of any fee for burial specified in item 1 in the Schedule; and
(b)waive the payment of any fee specified in items 2 and 3 in the Schedule.”.
Amendment of Schedule
6.  Item 3 in the Schedule to the principal Regulations is deleted and the following item substituted therefor:

Miscellaneous amendments
7.  The principal Regulations are amended —
(a)by deleting the word “Commissioner” wherever it appears in the following provisions and substituting in each case the word “Director-General”:
Regulations 3, 4, 6, 8, 9, 10 and 11; and
(b)by deleting the words “a public health officer” in regulation 11(1) and substituting the words “an authorised officer”.
