Central Provident Fund Act
(Chapter 36)
Central Provident Fund (Medishield Scheme) (Amendment) Regulations 2001
In exercise of the powers conferred by section 57 of the Central Provident Fund Act, the Minister for Manpower hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Central Provident Fund (MediShield Scheme) (Amendment) Regulations 2001 and shall be deemed to have come into operation on 1st January 2001.
Amendment of regulation 2
2.  Regulation 2(1) of the Central Provident Fund (MediShield Scheme) Regulations (Rg 20) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the word “who” in the definition of “dependant” and substituting the words “, each of whom”; and
(b)by inserting, immediately after the definition of “gamma knife treatment”, the following definition:
“ “Government premium rebate” means the sum of money, equivalent to the amount of premium payable under the Scheme in Division 2 of Part II after deducting any premium rebate in regulation 17, which may be paid by the Government to a person under the MediShield Scheme for the Elderly;”.
Amendment of regulation 3
3.  Regulation 3 of the principal Regulations is amended —
(a)by deleting the word “These” and substituting the words “Except as expressly provided otherwise in these Regulations, these”;
(b)by deleting the words “member of the Fund” in paragraphs (a) to (e) and substituting in each case the word “person”;
(c)by deleting the words “any member or class of members of the Fund” in paragraph (f) and substituting the words “any person or class of persons”; and
(d)by renumbering the regulation as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraph:
(2)  Notwithstanding anything in paragraph (1)(a), these Regulations shall apply to an insured person whose policy period under the Scheme had commenced within the 12-month period immediately preceding his attaining 75 years of age, until the end of that policy period.”.
Amendment of regulation 5
4.  The principal Regulations are amended by renumbering regulation 5 as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraph:
(2)  Upon the termination of a person’s policy under paragraph (1), such provisions in these Regulations, as may be applicable to a person whose policy under the Scheme has been terminated under regulations 22 and 23, shall be applicable to him.”.
Amendment of regulation 6
5.  Regulation 6 of the principal Regulations is amended —
(a)by deleting the words “on or before 1st July 1996” in the 2nd line of paragraph (1) and substituting the words “at the time he becomes a member”; and
(b)by deleting the words “under paragraph (1)” in the 2nd line of paragraph (3) and substituting the words “in this Division”.
Amendment of regulation 7
6.  Regulation 7 (1) of the principal Regulations is amended —
(a)by deleting the word “member” and substituting the word “person”; and
(b)by deleting the words “on or before 1st July 1996”.
Amendment of regulation 8
7.  Regulation 8 (2) of the principal Regulations is amended by inserting, immediately after the word “dependant,” in the 3rd line, the words “after discounting any Government premium rebate which the member or his dependant may be entitled to receive,”.
Amendment of regulation 9
8.  Regulation 9 (4) of the principal Regulations is amended —
(a)by deleting the word “Any” in the 1st line and substituting the words “Subject to these Regulations, any”; and
(b)by inserting, immediately after the word “approved” in the last line, the words “, or from such other date as the Board may determine”.
Amendment of regulation 11
9.  Regulation 11 of the principal Regulations is amended —
(a)by deleting the word “member” in paragraph (1) and substituting the word “person”;
(b)by deleting the words “on or before 1st July 1996” in paragraph (1); and
(c)by deleting the word “Every” in paragraph (5) and substituting the words “Subject to these Regulations, every”.
Amendment of regulation 12
10.  Regulation 12 (2) of the principal Regulations is amended by inserting, immediately after the word “himself or his dependant,” where it first appears in the 4th line, the words “after discounting any Government premium rebate which the member or his dependant may be entitled to receive,”.
Amendment of regulation 13
11.  Regulation 13 of the principal Regulations is amended —
(a)by deleting the word “member” in the 2nd and in the 4th lines of paragraph (2) and substituting in each case the word “person”; and
(b)by inserting, immediately after paragraph (2), the following paragraph :
(3)  For the purpose of computing the amount that the Board may deduct under paragraph (1), the sum of $660 referred to in paragraph (1) shall include any Government premium rebate which the member may be entitled to receive.”.
Amendment of regulation 14
12.  Regulation 14 of the principal Regulations is amended —
(a)by deleting the word “Any” in the 1st line and substituting the words “Subject to these Regulations, any”; and
(b)by inserting, immediately after the word “approved” in the last line, the words “, or from such other date as the Board may determine”.
Amendment of regulation 16
13.  Regulation 16 of the principal Regulations is amended —
(a)by deleting the words “forthwith cease to be insured” in the last line of paragraph (1) and substituting the words “be deemed never to have been insured”;
(b)by deleting the words "paragraph (3)" in the 1st line of paragraph (2) and substituting the words "paragraphs (3) and (4)";
(c)by deleting the word "and" at the end of paragraph (2)(c);
(d)by inserting, immediately after "$660" in paragraph (2)(d), the words "per person per policy year";
(e)by deleting the full-stop at the end of sub-paragraph (d) of paragraph (2) and substituting the word "; and", and by inserting immediately thereafter the following sub-paragraph:
(e)any premium paid by a person using the Government premium rebate shall be refunded to the Government.”;
(f)by inserting, immediately after the words "No refund shall be made" in paragraph (3), the words "to a member or his medisave account"; and
(g)by inserting, immediately after paragraph (3), the following paragraph:
(4)  Where a claim has been made against the Board under these Regulations, before the date of cancellation of his insurance cover under paragraph (1), the premium refunded shall be calculated from the first policy year immediately following the policy year in which the last claim was made against the Board.”.
Amendment of regulation 17
14.  Regulation 17 of the principal Regulations is amended by inserting, immediately after the word "member" wherever it appears in paragraphs (1), (2) and (3), the words "or his dependant".
Amendment of regulation 18
15.  Regulation 18 of the principal Regulations is amended by inserting, immediately after the word "member" wherever it appears in paragraphs (1) and (2), the words "or his dependant".
Amendment of regulation 19
16.  Regulation 19 of the principal Regulations is amended by inserting, immediately after the word "person" in paragraph (a), the words "or member who insured him".
Amendment of regulation 21
17.  Regulation 21(2) of the principal Regulations is amended by inserting, immediately after the word "cover," in the 5th line, the words "after discounting any Government premium rebate which the member or his dependant may be entitled to receive,".
Deletion and substitution of regulation 22
18.  Regulation 22 of the principal Regulations is deleted and the following regulation substituted therefor:
Termination by insured person other than dependant
22.—(1)  An insured person who is not insured as a dependant may terminate his insurance cover under the Scheme at any time by giving written notice to the Board.
(2)  Where an insured person referred to in paragraph (1) terminates his insurance cover under the Scheme within 2 months from the date of the commencement of his insurance cover, the Board shall refund, in the manner set out in paragraph (4), the full amount of the premium paid by him for that policy year.
(3)  Where an insured person referred to in paragraph (1) terminates his insurance cover under the Scheme at any time after the second month of the date of the commencement of his insurance cover, the Board shall refund, in the manner set out in paragraph (4), the pro-rated amount of the premium in respect of the unexpired period of his insurance cover, provided he has not made a claim against the Board under these Regulations before the effective date of termination of his insurance cover under the Scheme.
(4)  The refund of the full amount of the premium referred to in paragraph (2), and the refund of the pro-rated amount of the premium in respect of the unexpired period of the insurance cover referred to in paragraph (3), shall be paid in the following manner:
(a)where the premium for the policy year was deducted entirely from the member’s medisave account, the refund shall be paid into the member’s medisave account;
(b)where the premium for the policy year was paid entirely using the Government premium rebate, the refund shall be paid to the Government in cash; and
(c)where the premium for the policy year was paid using the Government premium rebate, by deducting from the member’s medisave account, or by cash, or by any combination of these, such amount of the refund, as represents the proportionate amount of the Government premium rebate paid, if any, shall be paid to the Government in cash, and —
(i)where the balance remaining, after refund of the proportionate amount of the Government premium rebate, is less than the amount of premium paid in cash, such balance shall be paid to the member in cash; and
(ii)where the balance remaining, after refund of the proportionate amount of the Government premium rebate, is more than the amount of premium paid in cash, such balance shall be paid to the member in cash in respect of any amount of premium paid in cash, and any amount remaining thereafter shall be paid to his medisave account.”.
Amendment of regulation 23
19.  Regulation 23 of the principal Regulations is amended —
(a)by deleting the words "and has attained the age of 16 years" in paragraph (1); and
(b)by deleting paragraphs (3), (4) and (5) and substituting the following paragraph:
(3)  Regulation 22(2), (3) and (4) shall apply, with the necessary modifications, to an insured person in respect of whom a written notice to terminate his insurance cover under the Scheme has been given under paragraph (2).”.
Amendment of regulation 24
20.  The principal Regulations are amended by renumbering regulation 24 as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraph:
(2)  An insured person whose policy under the Scheme has been terminated by the Board under regulation 25 (2) shall cease to be insured under the Scheme with effect from the date he ceased to be either a citizen or permanent resident of Singapore, or from such later date as may be determined by the Board.”.
Amendment of regulation 25
21.  Regulation 25 of the principal Regulations is amended —
(a)by deleting paragraph (a); and
(b)by renumbering the regulation as paragraph (1) of that regulation, and by inserting immediately thereafter the following paragraphs:
(2)  When a person insured under the Scheme ceases to be either a citizen or permanent resident of Singapore, the Board may terminate his policy under the Scheme.
(3)  Notwithstanding anything in regulation 3 (1), these Regulations shall continue to apply to an insured person referred to in paragraph (2) until such date as his policy under the Scheme may be terminated by the Board.”.
Amendment of regulation 27
22.  Regulation 27 of the principal Regulations is amended by deleting the words "member for himself or" in sub-paragraph (a) and substituting the words "person for himself or by a member".
