Auxiliary Police Forces
(Amendment) Regulations 2022
In exercise of the powers conferred by section 104 of the Police Force Act 2004, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Auxiliary Police Forces (Amendment) Regulations 2022 and come into operation on 2 September 2022.
Amendment of regulation 21
2.  In regulation 21(1) of the Auxiliary Police Forces Regulations (Rg 2) (called in these Regulations the principal Regulations) —
(a)in sub‑paragraph (m), replace the full‑stop at the end with a semi‑colon; and
(b)after sub‑paragraph (m), insert —
(n)revealing any information of a private or confidential nature which was acquired by him or which came to his knowledge in the course of his duties, otherwise than in the performance of his duties.”.
Replacement of regulation 31
3.  Regulation 31 of the principal Regulations is replaced with —
Meaning of “associate” in Part 9 of Act
31.  For the purposes of Part 9 of the Act, a person (A) is an associate of another person (B) if —
(a)A is the spouse or a parent, remoter lineal ancestor or step‑parent or a son, daughter, remoter issue, stepson or stepdaughter or a brother or sister, of B;
(b)A is a body corporate that is, or a majority of the directors of which are, accustomed or under an obligation whether formal or informal to act in accordance with the directions, instructions or wishes of B;
(c)A is a person who is accustomed or under an obligation, whether formal or informal, to act in accordance with the directions, instructions or wishes of B;
(d)A is a subsidiary (within the meaning given by section 5 of the Companies Act 1967) of B;
(e)A is a body corporate in which B, alone or together with other associates of B as described in paragraphs (b), (c) and (d), is in a position to control at least 20% of the voting power in A; or
(f)A is a person with whom B has an agreement or arrangement (whether oral or in writing and whether express or implied) to act together with respect to the acquisition, holding or disposal of shares or other interests in, or with respect to the exercise of their voting power in relation to, the Auxiliary Police Force.”.
Deletion of regulation 32
4.  Delete regulation 32 of the principal Regulations.
