Patents (Excluded Day) Rules 2002
In exercise of the powers conferred by sections 111 and 115 of the Patents Act, the Minister for Law, after consultation with the Intellectual Property Office of Singapore, hereby makes the following Rules:
Citation
1.  These Rules may be cited as the Patents (Excluded Day) Rules 2002.
Excluded day
2.  In addition to the excluded days set out in rule 99 of the Patents Rules (R 1), 11th February 2002 shall be an excluded day for all purposes under the Act and the Patents Rules except for —
(a)any inspection of the register of patents under section 42 of the Act;
(b)the filing of any application for a patent, not being an application in or in connection with which a declaration for priority referred to in section 17(2) of the Act is made; and
(c)the filing of any international application for a patent which does not contain a declaration referred to in Article 8 of the Patent Co-operation Treaty claiming the priority of one or more earlier applications filed in or for any country party to the Paris Convention.
Hours of business
3.—(1)  For the purposes of rule 2, the Registry shall be open to the public on 11th February 2002 between 8.30 a.m. and 5.30 p.m.
(2)  The Registry shall be deemed to be closed between 12.00 a.m. and 8.30 a.m. and between 5.30 p.m. and midnight on 11th February 2002.
(3)  Notwithstanding paragraphs (1) and (2), any document referred to in rule 97(2) of the Patents Rules (R 1) which relates to any of the purposes set out in rule 2(b) and (c) and which is transmitted by facsimile and is received by the Registry before midnight on 11th February 2002 shall, subject to rule 97(2) of those Rules, be considered as having been submitted and received by the Registry on 11th February 2002.
(4)  Where the document in one single transmission contains more than one sheet of information, the document shall be considered as having been submitted on the day by which all the sheets comprising the complete document have been received by the Registry before midnight on that day.
(5)  The date and time recorded by the Registry’s facsimile machine shall, until the contrary is proved, be evidence of the date and time the documents are received by the Registry.
