and Management Act
(Amendment of Second Schedule) (No. 3)
Order 2017

In exercise of the powers conferred by section 76(1) of the Environmental Protection and Management Act, the Minister for the Environment and Water Resources makes the following Order:

Citation and commencement

1. This Order is the Environmental Protection and Management Act (Amendment of Second Schedule) (No. 3) Order 2017 and comes into operation on 30 June 2018.

Amendment of Part I of Second Schedule

2. Part I of the Second Schedule to the Environmental Protection and Management Act is amended —

(a)

by inserting, immediately below the word “Phosphamidon” in the substance “Phosphorous compounds used as pesticides (insecticides, acaricides, etc.), which includes but is not limited to:”, the word “Trichlorfon”;

(b)

by deleting the word “Trichlorfon;” under the heading “Exclusions” against the substance “Phosphorous compounds used as pesticides (insecticides, acaricides, etc.), which includes but is not limited to:”;

(c)

by inserting, immediately below the substance “Polychlorinated biphenyls”, the following substance:

“

Polychlorinated naphthalenes

”; and

(d)

by inserting, immediately below the substance “Pyrethroid compounds used as pesticides, the following:”, the following substance:

“

Short-chain chlorinated paraffins (chain lengths at least C₁₀ but not exceeding C₁₃)

”.

Amendment of Part II of Second Schedule

3. Part II of the Second Schedule to the Environmental Protection and Management Act is amended —

(a)

by deleting the item “Adhesives;” and substituting the following item:

“Adhesives other than those containing any of the following substances as defined in Part I of this Schedule: polychlorinated naphthalenes or short-chain chlorinated paraffins;”;

(b)

by inserting, immediately below the item “Loading materials”, the following item:

“Lubricants other than those containing any of the following substances as defined in Part I of this Schedule: polychlorinated naphthalenes or short-chain chlorinated paraffins;”;

(c)

by deleting the item “Motor fuels and lubricants except diesel oil and petrol;” and substituting the following item:

“Motor fuels other than diesel oil and petrol;”;

(d)

by deleting the item “Paints other than paints containing mercury compounds, paints containing lead compounds and paints containing asbestos as defined in Part I of this Schedule;” and substituting the following item:

“Paints other than those containing any of the following substances as defined in Part I of this Schedule: asbestos, lead compounds, mercury compounds, polychlorinated naphthalenes, or short-chain chlorinated paraffins;”; and

(e)

by deleting the item “Plastics;” and substituting the following item:

“Plastics other than those containing any of the following substances as defined in Part I of this Schedule: polychlorinated naphthalenes or short-chain chlorinated paraffins;”.
