Trial of Offences) (Amendment)
Regulations 2023
In exercise of the powers conferred by section 115(1) of the Civil Defence Act 1986, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Civil Defence (Arrest, Searches, Investigation and Trial of Offences) (Amendment) Regulations 2023 and come into operation on 5 December 2023.
Amendment of regulation 16
2.  In the Civil Defence (Arrests, Searches, Investigation and Trial of Offences) Regulations (Rg 2) (called in these Regulations the principal Regulations), in regulation 16, replace paragraph (2) with —
(2)  The report must be sent to —
(a)the director and deputy director of the department of the Force responsible for human resources; and
(b)the Commissioner.”.
Amendment of regulation 28
3.  In the principal Regulations, in regulation 28(c), replace “work” with “duty”.
Amendment of regulation 31
4.  In the principal Regulations, in regulation 31 —
(a)in the section heading, replace “work” with “duty”;
(b)in paragraph (1), replace “extra work” with “extra duty”;
(c)in paragraph (1)(a), after “an extra period of”, insert “the offender’s normal daily”;
(d)in paragraph (1)(a), insert “and” at the end;
(e)in paragraph (1), delete sub‑paragraph (b);
(f)in paragraph (2), replace “Sunday” with “designated rest day”; and
(g)after paragraph (2), insert —
(3)  For the purposes of paragraph (2), “designated rest day”, in relation to an offender, means the day of each week designated as the offender’s rest day in the Civil Defence General Orders made under section 110 of the Act.”.
