Planning (Changes in Use — Lodgment Authorisation) (Amendment) Notification 2011

In exercise of the powers conferred by section 21(6) of the Planning Act, the Minister for National Development hereby makes the following Notification:

Citation and commencement

1. This Notification may be cited as the Planning (Changes in Use — Lodgment Authorisation) (Amendment) Notification 2011 and shall come into operation on 23rd February 2011.

Amendment of paragraph 2

2. Paragraph 2 of the Planning (Changes in Use — Lodgment Authorisation) Notification (N 5) (referred to in this Notification as the principal Notification) is amended —

(a)	by deleting the definitions of “HDB” and “HDB living quarter”; and
(b)	by deleting the words “or 4A(2)(f), as the case may be,” in the definition of “relevant date”.

Deletion and substitution of paragraph 3

3. Paragraph 3 of the principal Notification is deleted and the following paragraph substituted therefor:

“Authorisation of change in use

3. Subject to paragraph 4 and any other written law, any change in use of any part of a building specified in the first column of the First Schedule (referred to in this Notification as the relevant premises) to any purpose in any Use Class or to any use specified in the second column thereof, in relation to that building, is hereby authorised.”.

Amendment of paragraph 4

4. Paragraph 4 of the principal Notification is amended —

(a)	by deleting the words “or in the first column of the Second Schedule” in sub-paragraph (1)(b);
(b)	by deleting the words “or the second column of the Second Schedule, as the case may be,” in sub-paragraph (1)(b)(ii);
(c)	by deleting sub-paragraph (h) of sub-paragraph (1);
(d)	by deleting “(h),” in sub-paragraph (1)(k)(iii)(C);
(e)	by deleting sub-paragraph (v) of sub-paragraph (1)(k); and
(f)	by deleting sub-paragraph (2).

Deletion of paragraph 4A

5. Paragraph 4A of the principal Notification is deleted.

Amendment of paragraph 5

6. Paragraph 5(1) of the principal Notification is amended by deleting the words “and, where applicable, paragraph 4(2),”.

Deletion and substitution of paragraph 5A

7. Paragraph 5A of the principal Notification is deleted and the following paragraph substituted therefor:

“Authorisation not to apply

5A. This Notification shall not apply to any change in use which is authorised under the Planning (Use Classes) Rules (R 2), the Planning (Development of Land Authorisation) Notification (N 1) or the Planning (Housing and Development Board Commercial Premises and Living Quarters Authorisation) Notification 2011 (G.N. No. S 81/2011).”.

Amendment of First Schedule

8. Item 3 in the First Schedule to the principal Notification is deleted.

Deletion of Second Schedule

9. The Second Schedule to the principal Notification is deleted.

Amendment of Fourth Schedule

10. The Fourth Schedule to the principal Notification is amended —

(a)

by deleting the Schedule reference and substituting the following Schedule reference:

“Paragraphs 2 and 4(1)(g), (i), (ia) and (j) and First Schedule”; and

(b)

by deleting Part V.

Deletion of Sixth Schedule

11. The Sixth Schedule to the principal Notification is deleted.

Savings

12.—(1) Notwithstanding paragraphs 3, 4, 6, 8, 9 and 10, any change in use of any part of a building specified in item 3 in the first column of the First Schedule, the Second Schedule or Part V of the Fourth Schedule to the principal Notification as in force immediately before 23rd February 2011, being a change in use that is authorised by paragraph 3 of the principal Notification as in force immediately before that date, shall continue to be so authorised as if this Notification had not been made.

(2) Notwithstanding paragraphs 2, 5 and 11, any change in use of any HDB living quarters that is authorised by paragraph 4A of the principal Notification as in force immediately before 23rd February 2011 shall continue to be so authorised as if this Notification had not been made.
