Bankruptcy (Costs) (Amendment) Rules 2005
In exercise of the powers conferred by section 166 of the Bankruptcy Act, the Minister for Law hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Bankruptcy (Costs) (Amendment) Rules 2005 and shall come into operation on the date of commencement of item (3) in the First Schedule to the Statutes (Miscellaneous Amendments) (No. 2) Act 2005 (Act 42 of 2005).
Amendment of rule 7
2.  Rule 7 of the Bankruptcy (Costs) Rules (R 2) is amended by deleting paragraph (2) and substituting the following paragraph:
(2)  Without prejudice to the generality of paragraph (1), the costs to be allowed to a debtor’s solicitor who has acted for the debtor in the obtaining of a bankruptcy order on a debtor’s bankruptcy application shall be as provided in the Schedule unless the court, on application by the debtor’s solicitor by way of summons, orders otherwise.”.
Amendment of Schedule
3.  The Schedule to the Bankruptcy (Costs) Rules is amended —
(a)by deleting the heading immediately above item 1 and substituting the following heading:
CREDITOR –– APPLICANT’S COSTS”; and
(b)by deleting the word “petition” in items 1 and 3 and substituting in each case the words “bankruptcy application”.
