(Amendment of Second Schedule)
(No. 2) Order 2025
In exercise of the powers conferred by section 76(1) of the Environmental Protection and Management Act 1999, the Minister for Sustainability and the Environment makes the following Order:
Citation and commencement
1.  This Order is the Environmental Protection and Management Act 1999 (Amendment of Second Schedule) (No. 2) Order 2025 and comes into operation on 1 January 2026.
Amendment of Second Schedule
2.  In the Environmental Protection and Management Act 1999, in the Second Schedule —
(a)in Part I, replace the item “Formaldehyde” with —
Formaldehyde
Photographic glazing or hardening solutions;
 
Any substance (except paint) containing not more than 5%, weight in weight, of formaldehyde;
 
Paint containing less than 0.01%, weight in weight, of formaldehyde;
 
Paint containing formaldehyde for application on outdoor areas or for industrial use, if —
 
(a)the paint is sold or supplied in a container with a label affixed on the exterior of the container; and
 
(b)the label complies with Part IV of this Schedule.
Formaldehyde in paint
Paint containing less than 0.01%, weight in weight, of formaldehyde;
 
Paint containing formaldehyde for application on outdoor areas or for industrial use, if —
 
(a)the paint is sold or supplied in a container with a label affixed on the exterior of the container; and
 
(b)the label complies with Part IV of this Schedule.

(b)in Part II, in the item relating to “Paints”, after “asbestos,”, insert “formaldehyde,”; and
(c)after Part III, insert —
Part IV
Labels for paint containing
formaldehyde for application
on outdoor areas or for industrial use
  The label must —
(a)contain the following words clearly legible:
 
This paint contains formaldehyde.
 
For application on outdoor areas or for industrial use only.
 
Do not apply on indoor areas.”; and
(b)conform to the following dimensions:
(i)where the capacity of the container does not exceed 3 litres — at least 52 × 74 millimetres;
(ii)where the capacity of the container exceeds 3 litres but does not exceed 50 litres — at least 74 × 105 millimetres;
(iii)where the capacity of the container exceeds 50 litres but does not exceed 500 litres — at least 105 × 148 millimetres;
(iv)where the capacity of the container exceeds 500 litres — at least 148 × 210 millimetres.”.
