Citation and commencement |
1. These Regulations may be cited as the Business Trusts (Appeals) Regulations 2005 and shall come into operation on 6th January 2005. |

Secretary of Appeal Advisory Panel |
4.—(1) The Minister may appoint one or more officers or employees of the Authority to be a secretary of the Appeal Advisory Panel.

5.—(1) Every Appeal Advisory Committee shall consist of —

6.—(1) An appellant may appeal to the Minister by lodging with the secretary —

Powers of Appeal Advisory Committee to hear witness and admit evidence |
7.—(1) An Appeal Advisory Committee may, in its discretion, hear any witness and may admit or reject any evidence adduced, whether oral or documentary, and whether admissible or inadmissible under any written law for the time being in force relating to the admissibility of evidence.

Withdrawal of appeal |
8. The appellant may at any time, before the Minister confirms, varies or reverses the decision of the Authority on appeal, withdraw his appeal by serving on the secretary a written notice to that effect. |
Postponements |
9. An Appeal Advisory Committee may postpone or adjourn any sitting of the Committee at any time. |
Inquiry not open to public |
10. Every Appeal Advisory Committee shall sit in private. |
Confidentiality |
11.—(1) Subject to paragraph (2), no person shall, unless authorised by the Minister, disclose any written or other report, information, document or evidence, or part thereof, placed before an Appeal Advisory Committee to any other person, except to the secretary, a member of the Committee, the Authority or the appellant (or his advocate and solicitor).

Report of Appeal Advisory Committee |
12.—(1) The Appeal Advisory Committee shall submit its report to the Minister within 28 days of the appeal having been referred to the Committee, or such further period as may be permitted by the Minister upon the request of the Committee made before the expiry of the period of 28 days.

Dissolution of Appeal Advisory Committee |
13. An Appeal Advisory Committee constituted in respect of an appeal shall dissolve upon the withdrawal of that appeal or upon the Minister confirming, varying or reversing the decision of the Authority on appeal. |
