(Fixed Installation Contractors — Exemption)
Order 2022
In exercise of the powers conferred by section 30 of the Building Control Act 1989, the Minister for National Development makes the following Order:
Citation and period in force
1.—(1)  This Order is the Building Control (Fixed Installation Contractors — Exemption) Order 2022.
(2)  This Order is in force for 6 months starting 9 December 2022.
Definition
2.  In this Order, “registrable activity” has the meaning given by section 29M of the Act.
Exemption for person registered with Building and Construction Authority to carry out certain registrable activities
3.—(1)  A person who, immediately before 9 December 2022, is registered with the Building and Construction Authority to maintain escalators is exempt from the provisions in Part 5B of the Act in relation to carrying out the maintenance, inspection or testing of escalators or any combination of those activities.
(2)  A person who, immediately before 9 December 2022, is registered with the Building and Construction Authority to maintain lifts is exempt from the provisions in Part 5B of the Act in relation to carrying out the maintenance, inspection or testing of lifts or any combination of those activities.
Exemption from application fee
4.—(1)  Subject to sub‑paragraph (3), a person exempt under paragraph 3(1) who applies to be registered under Part 5B of the Act to carry out the maintenance, inspection or testing of escalators or any combination of those activities is exempt from the requirement to pay an application fee mentioned in section 29O(2)(b) of the Act.
(2)  Subject to sub‑paragraph (3), a person exempt under paragraph 3(2) who applies to be registered under Part 5B of the Act to carry out the maintenance, inspection or testing of lifts or any combination of those activities is exempt from the requirement to pay an application fee mentioned in section 29O(2)(b) of the Act.
(3)  The exemption from the requirement to pay an application fee applies if —
(a)the person is applying to be registered under Part 5B of the Act for the first time; and
(b)the application is made before this Order ceases to be in force.
Exemption for person to carry out certain registrable activities
5.  A person is exempt from the provisions in Part 5B of the Act in relation to carrying out the following registrable activities:
(a)fixed installation works for escalators;
(b)fixed installation works for lifts;
(c)fixed installation works for mechanised car parking systems;
(d)the maintenance, inspection or testing of mechanised car parking systems or any combination of those activities.
End of exemption to carry out registrable activities
6.  An exemption under paragraph 3 or 5 for a person in relation to carrying out a registrable activity ceases when the person is registered under Part 5B of the Act to carry out the registrable activity.
