Citation
1.  These Regulations may be cited as the Workplace Safety and Health (Offences and Penalties) (Subsidiary Legislation under section 66(14)) Regulations.
Offences and penalties
2.—(1)  In the event of any contravention in, or in connection with, or in relation to, a factory of any subsidiary legislation made under the repealed Act which continues to be in force in factories by virtue of section 66(14) of the Act —
(a)where the subsidiary legislation expressly imposes any requirement, duty or prohibition on any person, that person shall be guilty of an offence; and
(b)in any other case, the occupier of the factory shall be guilty of an offence.
(2)  Any person guilty of an offence under paragraph (1) shall be liable on conviction —
(a)if he is an employed person, to a fine not exceeding $2,000; and
(b)in any other case, to a fine not exceeding $5,000,
and, if the contravention in respect of which he was so convicted continues after the conviction, he shall (subject to section 52 of the Act) be guilty of a further offence and shall be liable to a fine not exceeding $200 for every day or part thereof during which the contravention continues after conviction.
(3)  In relation to a contravention which was likely to cause the death of, or bodily injury to, any person, the person guilty of an offence under paragraph (1) shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 6 months or to both and, if the contravention in respect of which he was so convicted continues after the conviction, he shall (subject to section 52 of the Act) be guilty of a further offence and shall be liable to a fine not exceeding $2,000 for every day or part thereof during which the contravention continues after conviction.
(4)  In relation to a contravention which results in a dangerous occurrence or in serious bodily injury to any person, the person guilty of an offence under paragraph (1) shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both.
(5)  In relation to a contravention which results in the death of any person, the person guilty of an offence under paragraph (1) shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 2 years or to both.
