(Government Arms Exhibitions —
Exemption from Section 13)
Order 2018

In exercise of the powers conferred by section 44B of the Arms and Explosives Act, the Minister for Home Affairs makes the following Order:

Citation and commencement

1. This Order is the Arms and Explosives (Government Arms Exhibitions — Exemption from Section 13) Order 2018 and comes into operation on 24 May 2018.

Definitions

2. In this Order, unless the context otherwise requires —

“arms exhibition” means an event (such as an exhibition, or a fair or show) —

(a)

involving either or both the temporary —

(i)	display of arms or explosives, but not for purposes of sale, at any place (open to the air or otherwise); or
(ii)	use of arms or explosives for a target shooting activity; and

(b)

to which members of the public have access as of right or by virtue of express or implied permission, free or on payment of a fee,

whether or not the event is held in combination with other events;

“Government” includes any Ministry or department of the Government or an Organ of State, but not a Government school or Government‑aided school;

“organiser”, in relation to an event, means a person who is responsible for promoting, conducting or holding the event and, where any person will receive revenue from the sale (if any) of tickets to the event, includes that person;

“target shooting activity” means the use of any arms to shoot shots, bullets or other missiles at a fixed or moving target;

“working day” means any day except a Saturday, Sunday or public holiday.

Exemption of organiser

3. A person organising an arms exhibition by or on behalf of the Government is exempt from section 13 of the Act for having in the person’s possession or under the person’s control any arms or explosives, where —

(a)

the Licensing Officer has received, at least 14 working days (or such shorter notice where the Licensing Officer is reasonably satisfied that earlier notice could not have been given) before the start of the arms exhibition, a written notice about the event;

(b)

for an arms exhibition involving the display of arms or explosives —

(i)	the arms are de‑activated to the satisfaction of the Licensing Officer and the explosives are inert; and
(ii)	the arms or explosives are displayed only during the arms exhibition and within an area demarcated by the organiser for the display of those arms or explosives;

(c)

for an arms exhibition involving a target shooting activity —

(i)	the target shooting activity is confined to the shooting range at the place where the arms exhibition is held; and
(ii)	where explosives are used, this is limited to simulated ammunition or inert projectiles provided by a public officer of the Government organising the arms exhibition or for whom the arms exhibition is organised; and

(d)

the organiser complies with all measures the Licensing Officer specifies before the start of the arms exhibition to protect the safety and security of the arms exhibition, such as —

(i)	securing arms and explosives;
(ii)	reinforcing barriers at the shooting range for target shooting activities;
(iii)	cordoning off or adjusting the boundaries of demarcated areas where arms or explosives are possessed or controlled; or
(iv)	deploying officers to supervise safety and security.

Exemption of participant at arms exhibition

4. An individual attending an arms exhibition organised by or on behalf of the Government by an organiser who is exempt from section 13 of the Act is exempt from that section for having in the individual’s possession or under the individual’s control any arms or explosives provided at that arms exhibition by the organiser.
