Diplomatic and Consular Relations
(UNFCCC NAMA Regional Workshop 2013)
Order 2013
In exercise of the powers conferred by section 6(3) of the Diplomatic and Consular Relations Act, the Minister for Foreign Affairs hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Diplomatic and Consular Relations (UNFCCC NAMA Regional Workshop 2013) Order 2013 and shall come into operation on 11th August 2013.
Definitions
2.  In this Order —
“Convention” means the United Nations Framework Convention on Climate Change adopted at New York on 9th May 1992;
“Protocol” means the Protocol to the Convention adopted at Kyoto on 11th December 1997;
“Secretariat” means the secretariat to the Convention and the Protocol;
“Workshop” means the UNFCCC Regional Workshop on Promoting International Collaboration to Facilitate Preparation, Submission and Implementation of Nationally Appropriate Mitigation Actions (NAMA) in Asia, to be held in Singapore between 13th August 2013 and 15th August 2013 (both dates inclusive).
Purpose
3.  The purpose of this Order is to extend immunities and privileges to —
(a)participants of the Workshop in connection with their attendance at the Workshop;
(b)staff of the Secretariat in connection with their responsibilities for the Workshop; and
(c)the premises for the Workshop for the duration of the Workshop.
Immunities and privileges
4.—(1)  The representatives of Parties to the Convention and the Protocol and of the Observer States shall enjoy the following immunities and privileges while exercising their functions, during the Workshop and when travelling to and from the Workshop, as applicable:
(a)immunity from arrest and detention and from seizure of personal baggage, and immunity from legal process of every kind in respect of words spoken or written and all acts done by them in their capacity as such representatives;
(b)inviolability of all papers and documents;
(c)the right to use codes and to receive papers or correspondence by courier or in sealed bags;
(d)the same immunities and facilities in respect of their personal baggage as are accorded to an envoy of a sovereign Power accredited to the Republic of Singapore;
(e)such other privileges, immunities and facilities (not inconsistent with sub‑paragraphs (a) to (d)) as are enjoyed by an envoy of a sovereign Power accredited to the Republic of Singapore, except that there shall be no relief from customs duty, excise duty or the goods and services tax.
(2)  The representatives of specialised agencies of the United Nations and of the International Atomic Energy Agency shall enjoy the following immunities and privileges while exercising their functions, during the Workshop and when travelling to and from the Workshop, as applicable:
(a)immunity from arrest and detention and from seizure of personal baggage, and immunity from legal process of every kind in respect of words spoken or written and all acts done by them in their capacity as such representatives;
(b)exemption from income tax.
(3)  Other participants of the Workshop invited by the Secretariat shall enjoy the following immunities and privileges while exercising their functions, during the Workshop and when travelling to and from the Workshop, as applicable:
(a)immunity from arrest and detention and from seizure of personal baggage, and immunity from legal process of every kind in respect of words spoken or written and all acts done by them in their capacity as such participants;
(b)inviolability of all papers and documents;
(c)for the purpose of communicating with the United Nations, the right to use codes and to receive papers or correspondence by courier or in sealed bags;
(d)the same immunities and facilities in respect of their personal baggage as are accorded to an envoy of a sovereign Power accredited to the Republic of Singapore.
(4)  Staff of the Secretariat shall enjoy the following immunities and privileges, as applicable:
(a)immunity from arrest and detention and from seizure of personal baggage, and immunity from legal process of every kind in respect of words spoken or written and all acts done by them in their capacity as staff of the Secretariat;
(b)exemption from income tax.
(5)  The premises of the Workshop shall be inviolable between 13th August 2013 and 15th August 2013 (both dates inclusive).
Waiver of immunity or privilege
5.  Any immunity or privilege conferred on a person under paragraph 4(3) or (4) does not apply to him if it has been waived in his case by the Secretariat.
Non-application of immunities and privileges
6.  No immunity or privilege referred to in paragraph 4 shall be enjoyed by —
(a)a representative of the Government;
(b)a consultant or an expert nominated by the Government who is a citizen or permanent resident of Singapore;
(c)a person recruited in Singapore to provide services in connection with the Workshop and who is a citizen or permanent resident of Singapore; or
(d)any participant of the Workshop invited by the Secretariat, not being one referred to in paragraph 4(1) or (2), who is a citizen or permanent resident of Singapore.
