Environmental Public Health (Composition of Offences) Rules 2003

In exercise of the powers conferred by section 104(3) of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment, hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Environmental Public Health (Composition of Offences) Rules 2003 and shall come into operation on 29th December 2003.

Compoundable offences

2. The following offences may be compounded by the Director-General in accordance with section 104(1) of the Act:

(a)

any offence under —

(i)	section 6(3), 9(1), 10, 11(2), 13(4), 19(2), 23(6), 26, 27, 28, 32(2), 38(2), 39(3), 41(2), 47, 48(1), 49(1), 52, 53, 54(2), 56, 57(1), 58(2), 59(4), 60(2) or (3), 61, 64(1), 79 or 101, read with section 85(1), of the Act;
(ii)	section 7(2), 8(2), 9(2), 14, 16(2), 23(7), 25, 31(7), 49(3) or (5), 50, 55, 59(1) or (3), 62(2) or (3), 78, 82 or 99(12), read with section 103, of the Act;
(iii)	section 12(1), 13(3), 17(3), 18, 19(1) or (4), 31(8), 58(5), 73(4), 86(3) or 99(7) of the Act;
(iv)	section 32(1), 33, 34(1), 35, 36, 37(5), 38(1), 39(1) or (2), 40(1) or (9) or 41(1), read with section 42(1), of the Act;
(v)	section 63 or 64(2), read with section 65, of the Act; or
(vi)	section 67, 68, 69(1) or (2), 70, 72(1), 73(1) or 75(1), read with section 77, of the Act;

(b)

any offence under the Environmental Public Health (Burning of Joss Sticks and Candles) Regulations (Rg 1);

(c)

any offence under the Environmental Public Health (Public Cleansing) Regulations (Rg 3);

(d)

any offence under the Environmental Public Health (Funeral Parlours) Regulations (Rg 5);

(e)

any offence under the Environmental Public Health (Crematoria) Regulations (Rg 6);

(f)

any offence under the Environmental Public Health (Cemeteries) Regulations (Rg 9);

(g)

any offence under the Environmental Public Health (Swimming Pools) Regulations (Rg 10);

(h)

any offence under the Environmental Public Health (General Waste Collection) Regulations (Rg 12);

(i)

any offence under the Environmental Public Health (Food Hygiene) Regulations (Rg 16).

Revocation

3. The Environmental Public Health (Composition of Offences) Rules (R 1) are revoked.
