Immigration (Specified Pass Holders — Exemption from Section 6(2)) Order 2008

In exercise of the powers conferred by section 56 of the Immigration Act, the Minister for Home Affairs hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Immigration (Specified Pass Holders — Exemption from section 6(2)) Order 2008 and shall come into operation on 6th August 2008.

Definitions

2. In this Order, unless the context otherwise requires —

“dependant’s pass” means a pass issued under regulation 11 of the Immigration Regulations (Rg 1);

“student’s pass” means a pass issued under regulation 14 of the Immigration Regulations;

“visit pass” means a pass issued under regulation 12 of the Immigration Regulations but does not include a multiple journey visit pass.

Exemption from disembarkation card and embarkation card requirements

3. Subject to paragraph 4, the holder of a dependant’s pass, student’s pass or visit pass shall be exempt from section 6(2) of the Act when leaving Singapore during the validity period of the pass if he has not been issued with a disembarkation and embarkation card under regulation 19 of the Immigration Regulations (Rg 1).

Non-application and cessation of exemption

4.—(1) The exemption under paragraph 3 shall not apply to —

(a)	the holder of a dependant’s pass, student’s pass or visit pass who has given incorrect information in the application form for the pass; and
(b)	the holder of a visit pass issued in the form of an endorsement on the passport or other travel document of the holder.

(2) If by reason of a change in circumstances —

(a)

any of the following particulars furnished by or on behalf of the holder of a dependant’s pass, student’s pass or visit pass in the application form for the pass is no longer correct:

(i)	the pass holder’s name or nationality;
(ii)	the number or type of travel document the pass holder uses or will use to enter Singapore;
(iii)	the date of issue or date of expiry of the travel document the pass holder uses or will use to enter Singapore;
(iv)	the pass holder’s address in Singapore; or

(b)

any answer to a question in the application form for the pass is no longer correct,

and the pass holder fails, within the period of 14 days after the change in circumstances, to inform an immigration officer in writing of the new circumstances and of the correct particulars in those circumstances or the correct answer in those circumstances to the question, the exemption in paragraph 3 (as the case may be) shall, on the 15th day after the change, cease to apply to the pass holder.
