Medicines (Product Licence) (Exemption) Order 2001

In exercise of the powers conferred by section 9 of the Medicines Act, the Minister for Health hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Medicines (Product Licence) (Exemption) Order 2001 and shall come into operation on 1st October 2001.

Definitions

2. In this Order, “healthcare establishment” and “private hospital” have the same meanings as in the Private Hospitals and Medical Clinics Act (Cap. 248).

Product licence not necessary in certain circumstances

3. Sections 5(1) and 6(4) of the Act shall not apply to any person who sells, supplies, assembles or manufactures medicinal products which are assembled or manufactured —

(a)	under an agreement with any private hospital or any healthcare establishment;
(b)	in accordance with the chemical composition and written prescription specified by a doctor of that private hospital or healthcare establishment for use solely by or in connection with specific patients of that private hospital or healthcare establishment, as the case may be; and
(c)	in premises approved by the licensing authority.
