National Cadet Corps Regulations

Citation
1.  These Regulations may be cited as the National Cadet Corps Regulations.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“Assessment Board” means the Assessment Board constituted under regulation 29;
“Commandant” includes a Deputy Commandant and an Assistant Commandant;
“dependant” in relation to a cadet, includes the parent or lawful guardian of the cadet;
“member of the Corps” includes an honorary officer and an honorary instructor appointed under section 9 of the Act;
“school” includes a junior college.
Organisation
3.  The Corps shall consist of —
(a)a Central Corps Headquarters comprising the Commandant, Deputy Commandant, Assistant Commandants and such other officers and staff as the Commandant may appoint;
(b)Centres which are Open Units comprising such officers and cadets as the Commandant may determine; and
(c)School Units which are attached to or located at a school comprising cadets who are students in the school and such officers as the Commandant may determine.
Enrolment as a cadet
4.—(1)  Any student of a school who is —
(a)of the age of 12 years or above; or
(b)in a Secondary One Class or its equivalent,
and fulfils the requirements of section 8 of the Act may be enrolled as a cadet in any School Unit.
(2)  A person who desires to be enrolled as a cadet under this regulation shall —
(a)make an application to the principal of his school on such form as the Commandant may direct; and
(b)submit the written consent of his parent or lawful guardian to his enrolment as a cadet.
(3)  A person shall be enrolled as a cadet under this regulation for the duration of the period for which he is a student of the school in which his Unit is located.
(4)  Where a cadet ceases to be a student in the school in which he was enrolled as a cadet and subsequently becomes a student in another school, he may apply to the Commandant for permission to continue to be a cadet in the Unit of the other school.
(5)  A student who is enrolled as a cadet shall serve in the Unit located at the school to which he belongs except that he may be transferred at any time by the Commandant to an Open Unit or from an Open Unit to a School Unit.
(6)  A student shall cease to be a cadet on his leaving school.
Promotion of a cadet
5.—(1)  The Commandant shall determine the criteria for the advancement in rank of a cadet.
(2)  A Commanding Officer may promote a cadet in accordance with the criteria determined by the Commandant.
(3)  A Commanding Officer may, with the approval of the Commandant, waive any of the criteria referred to in paragraph (1) in respect of the promotion of any cadet.
Selection of officers
6.—(1)  The Commandant may constitute a Selection Board for the purpose of selecting persons to attend an Officer Cadet Course.
(2)  The Selection Board shall consist of not less than 3 members all of whom are to be appointed by the Commandant.
(3)  At least one member of the Selection Board shall be a representative of the Ministry of Education.
(4)  The principal of a school may submit the names of suitable members of the teaching staff of the school who are not below the age of 19 years for selection to undergo an Officer Cadet Course.
(5)  A member of the teaching staff of a school who has been selected by the Selection Board may undergo an Officer Cadet Course and upon the successful completion thereof the Council may recommend to the Minister to appoint him as an officer.
Appointment of officers
7.  The Council may make recommendations to the Minister on the appointment and promotion of officers.
Promotion of an officer
8.—(1)  The Council may, with the approval of the Minister, set the criteria for the advancement in rank of an officer.
(2)  The criteria for the advancement in rank shall be published as Standing Orders and brought to the notice of all officers.
(3)  The Council may waive any requirements in the criteria for the advancement in rank in respect of the promotion of any officer.
Release of officers
9.—(1)  The Council may make recommendations to the Minister to revoke the appointment of any officer on the grounds of ill-health, misconduct or any other reason which the Council sees fit.
(2)  An officer may apply in writing for a discharge from his appointment at any time on grounds of age, ill-health or any other reason. His application will be forwarded to the Commandant for submission to the Council which shall then make recommendations thereon to the Minister.
Medical examination
10.  The Commandant may require any person who is selected for an Officer Cadet Course or who is enrolled as a cadet and any officer or cadet who is selected for any course of training to undergo a medical examination.
Discharge
11.—(1)  Where a cadet is due to leave school, his Commanding Officer shall take the necessary steps to discharge him from the Corps.
(2)  Where the Commandant approves an application by a cadet to continue to be enrolled in the Corps pursuant to regulation 4(4), he may transfer the cadet to an Open Unit.
Release of a cadet
12.—(1)  The Commanding Officer of a cadet may approve an application made by him for his release from the Corps.
(2)  In the case of a cadet who is a student of a school the concurrence of the principal of the school concerned to the release of the cadet shall be obtained by the Commanding Officer.
National Cadet Corps General Orders
13.  The Commandant may issue National Cadet Corps General Orders from time to time which may contain all entries, appointments, promotions, awards, resignations and termination of service of officers and cadets and the retirement from service of officers.
Rank structure and badges of rank
14.  Insofar as it is practicable, the rank structure of the Corps shall follow the rank structure of the Singapore Armed Forces and the badges of rank to be worn by officers, officer-cadets and cadets shall be those in current use in the Singapore Armed Forces.
Cadet-Lieutenant
15.—(1)  Notwithstanding regulation 14, there is hereby created the rank of Cadet-Lieutenant.
(2)  The Commandant may appoint as a Cadet-Lieutenant any member of the Corps above the age of 16 years who has successfully completed such course of training as the Commandant may approve.

(3)  The badge of rank of a Cadet-Lieutenant shall be the badge of a Second Lieutenant mounted on white cloth material on each shoulder strap together with white cloth material backing for the shoulder titles.
(4)  The appointment of a Cadet-Lieutenant shall be terminated when he is discharged from the Corps, or if he has not been discharged, when he attains the age of 19 years.

Uniforms
16.—(1)  Insofar as it is practicable, the uniform of the Corps shall be the same as that worn by members of the Singapore Armed Forces.
(2)  A member of the Corps shall be issued free of charge with such uniforms and equipment as the Commandant may direct and such uniforms and equipment shall remain the property of the Corps at all times.
(3)  A member of the Corps shall not wear his uniform except when he is on duty or training or is proceeding to or from duty or training.
(4)  A person who ceases to be a member of the Corps shall return all uniforms and equipment issued to him and shall, unless otherwise exempted by the Commandant, pay for the cost of any item of uniform or equipment or the replacement therefor which he has failed to return.
(5)  The Commandant may refuse to accept any returned item of uniform or equipment in a damaged condition (fair wear and tear excepted) or accept it on the condition that the person returning it shall pay for the cost of the repair of or the replacement of the item.
Training and administration
17.—(1)  The Commandant shall be assisted in the training and administration of the Corps by such officers as are appointed by the Permanent Secretary of the Ministry of Defence and the Permanent Secretary of the Ministry of Education.
(2)  The Commandant shall be responsible for drawing up schemes of training and for the good order, discipline and welfare of members of the Corps.
(3)  The Commandant may, with the approval of the Council, make rules relating to awards in the form of badges and other insignias to cadets for proficiency in training and other achievements.
Appointment of Commanding Officer
18.—(1)  The Commandant, acting on the recommendation of the principal of the school in which the School Unit is located, shall appoint a Commanding Officer for the School Unit of that school.
(2)  The appointment of a Commanding Officer of an Open Unit shall be made by the Commandant.
Duties of Commanding Officers
19.—(1)  Commanding Officers shall be responsible to the Commandant for the discipline, training and welfare of their Units.
(2)  Commanding Officers shall —
(a)keep records showing the strength of their Units;
(b)keep records of attendance of all officers and cadets at parades;
(c)keep proper custody of uniform, accoutrements, stores, equipment and arms and keep records thereof;
(d)ensure that training is carried out as laid down in the training syllabus as well as other activities as may from time to time be organised by the Commandant; and
(e)keep officers and cadets informed of the relevant rules, regulations and instructions.
Public funds
20.  Funds raised from the public may only be expended on projects approved by the Council.
Disciplinary action against a cadet
21.—(1)  Where a cadet is to be dealt with summarily by his Commanding Officer under section 12 of the Act, a report in writing stating the particulars of the alleged misconduct, act or omission and the witnesses to such alleged misconduct, act or omission shall be made by the officer in immediate command of the cadet to the Commanding Officer of the Unit.
(2)  Where the Commanding Officer himself has made a complaint against any cadet or is a witness in the disciplinary proceedings against a cadet, he shall not deal with the cadet but shall refer him to the Commandant who may deal with the cadet in accordance with regulation 22.
Commencement of investigations
22.—(1)  On receiving the report made pursuant to regulation 21 the Commanding Officer, or the Commandant, as the case may be, shall as soon as practicable commence investigations into the alleged misconduct, act or omission.
(2)  Before a Commanding Officer or the Commandant commences any investigation, he shall explain to the cadet the allegations that have been made against him.
Manner of investigation
23.—(1)  An investigation of the allegations against a cadet shall be conducted in an informal manner in the presence of the cadet and he shall be afforded the opportunity to answer the allegations, call persons who can give evidence in support of his answers or cross-examine the persons making the allegations and other witnesses.
(2)  The officer carrying out the investigation may deal with the cadet in accordance with section 13 of the Act.
Report of incidents
24.—(1)  A Commanding Officer shall as soon as practicable complete and submit to the Commandant on such forms as the Commandant may direct a report of any incident resulting in any injury to or in the death of any member of the Corps when the injury or death arose out of or in the course of his training or duty.
(2)  In the case of any incident involving a cadet who is a student of a school, a copy of the report shall be submitted to the principal of the school to which the student belongs.
Duty allowance for officers
25.  An officer, honorary officer or honorary instructor may be paid a duty allowance per parade or camp at a rate approved by the Council and published in the National Cadet Corps General Orders from time to time.
Parades and camps
26.—(1)  For the purpose of the payment of the duty allowance —
(a)a parade shall include any training, administrative duties and attendance at meetings of not less than 6 hours’ duration; and
(b)a camp shall include any period of training that includes an overnight stay.
(2)  Where the duration of the training, administrative duties or attendance at meetings is less than 6 hours but more than two hours, a duty allowance of the equivalent of half the approved rates for a parade shall be paid.
Special allowances
27.  The Council may, subject to such regulations as may be prescribed, authorise the payment of such special allowances as it thinks fit to members and honorary instructors of the Corps.
Certificates
28.—(1)  A membership certificate shall be issued to a member of the Corps when he completes his term of service in the Corps.
(2)  No membership certificate shall be issued to any member of the Corps who is dismissed from the Corps or whose services are terminated on account of misconduct or for any other reason which, in the opinion of —
(a)the Council, in the case of officers; or
(b)the Commandant, in the case of cadets,
renders such termination desirable.
(3)  A certificate shall be issued to a member of the Corps who has successfully completed any specific course of training or any approved activity.
Assessment Board
29.—(1)  There may be constituted an Assessment Board for the purpose of making recommendations to the Minister on the awards of compensation to be made to members or their dependants in respect of death or personal injury arising out of or in the execution of the duty of a member and which is attributable solely to the discharge of his duty.
(2)  The Assessment Board shall consist of —
(a)a representative from the Ministry of Education;
(b)a representative from the Ministry of Defence;
(c)a representative from the Ministry of Finance;
(d)a representative from the Ministry of Health; and
(e)two other members,
all of whom shall be appointed by the Minister.
(3)  The Minister shall appoint one of the members of the Assessment Board to be the chairman.
Reference to Assessment Board
30.—(1)  A member of the Corps who suffers any injury or the dependants of a member of the Corps who is killed and which injury or death is attributable solely to the discharge of his duty may, within 3 months of the occurrence of any such injury or death, make an application to the Commandant for any award of compensation to be paid by the Minister under section 15 of the Act.
(2)  The Commandant shall upon receipt of any application made by a member of the Corps or his dependants refer the application forthwith to the Assessment Board which shall make its recommendations to the Minister.
(3)  The Commandant may in his discretion entertain an application for an award of compensation which is not made within the period of 3 months from the date of occurrence of the death or injury suffered by a member of the Corps.
Funeral expenses
31.  Where a member of the Corps is killed in the execution of his duty and his death is attributable solely to the discharge of duty, his dependants shall be entitled to be paid such funeral expenses as the Assessment Board may determine which shall not in any case exceed the sum of $200.
Medical or hospital expenses
32.  Where a member of the Corps suffers any injury arising out of or in the execution of his duty and which is attributable solely to the discharge of his duty and incurs medical or hospital expenses as a result of the injury, the Board may make a recommendation as to the payment of a sum of money to compensate the member for the expenses incurred in addition to any other award of compensation recommended by the Board.
