National Police Cadet Corps Regulations

Citation
1.  These Regulations may be cited as the National Police Cadet Corps Regulations.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“Assessment Board” means the Assessment Board established under regulation 32;
“Commandant” includes a Deputy Commandant and an Assistant Commandant;
“dependant”, in relation to a cadet, includes the parent or lawful guardian of the cadet;
“member of the Corps” includes an honorary officer and an honorary instructor appointed under section 8 of the Act;
“school” includes a junior college.
Organisation
3.  The Corps shall consist of —
(a)a National Police Cadet Corps Headquarters comprising the Commandant, Deputy Commandant, Assistant Commandants, Adjutant, Staff Officers and such other officers and persons as may be seconded under section 9 of the Act or appointed under regulation 19(1);
(b)centres which are open units comprising such officers and cadets as the Commandant may determine; and
(c)school units attached to or located in a school and comprising cadets who are students in the school and such officers as the Commandant may determine.
Enrolment as cadet
4.—(1)  A student of a school who is —
(a)of the age of 12 years or above; or
(b)in a secondary one class or its equivalent,
and fulfills the requirements of section 7 of the Act may be enrolled as a cadet in a school unit.
(2)  A person who desires to be enrolled as a cadet under this regulation shall —
(a)make an application to the principal of his school in such form as the Commandant may require;
(b)submit a written consent of his parent or lawful guardian to his enrolment as a cadet; and
(c)make a declaration before the Commandant in the form set out in the Schedule.
(3)  A person shall be enrolled as a cadet under this regulation for the duration of the period for which he is a student of a school.
(4)  Where a person who is enrolled as a cadet under this regulation ceases to be a student in a school, he may apply to the Commandant in writing for permission to continue to be enrolled as a cadet until he attains the age of 22 years.
Transfer of cadet
5.  A person who is enrolled as a cadet under regulation 4 shall serve in a school unit but he may be transferred at any time by the Commandant to an open unit or from an open unit to a school unit.
Promotion of cadet
6.—(1)  The Commandant shall determine the criteria for the promotion of a cadet.
(2)  The Commandant may promote a cadet up to the rank of lance-corporal in accordance with such criteria as may be determined under paragraph (1).
Selection of persons to attend Probationary Inspectors' Basic Course
7.—(1)  There shall be established a Selection Board which shall select persons to attend a Probationary Inspectors’ Basic Course.
(2)  The Selection Board shall consist of not less than 3 members, all of whom shall be appointed by the Commandant.
(3)  At least one member of the Selection Board established under paragraph (1) shall be a representative of the Ministry of Education.
(4)  The principal of a school may submit the names of suitable persons on the teaching staff of the school, who are not below the age of 19 years, for selection to attend the Probationary Inspectors’ Basic Course established under paragraph (1).
(5)  A person on the teaching staff of a school or otherwise who has been selected under this regulation may attend the Probationary Inspectors’ Basic Course and upon the successful completion thereof the Council may recommend to the Minister that the person be appointed Probationary Inspector or honorary Probationary Inspector under section 8(1) or (2) of the Act, as the case may be.
Appointment of officers
8.  The Council may make recommendations to the Minister on the appointment and promotion of officers.
Promotion of officers
9.—(1)  The Council may, with the approval of the Minister, set the criteria for the promotion of an officer.
(2)  The criteria for the promotion of an officer shall be published in the National Police Cadet Corps Orders issued under regulation 15.
(3)  The Council may waive any requirement in the criteria set for the promotion of an officer.
Release of officers
10.  The Council may recommend to the Minister that the appointment of an officer be revoked on the ground of any ill-health of the officer or misconduct by the officer or for any other reason which appears to the Council to warrant revocation of the appointment.
Application for discharge from appointment as officer
11.—(1)  An officer may at any time apply in writing for a discharge from his appointment on the ground of age or ill-health or for any other reason.
(2)  An application made under paragraph (1) shall be forwarded through the Commandant to the Council which shall then make such recommendation to the Minister on the application as it thinks fit.
Medical examination
12.  The Commandant may require —
(a)a person who is selected to attend a Probationary Inspectors’ Basic Course under regulation 6 or who is enrolled as a cadet under regulation 4; and
(b)an officer, or a cadet, who is selected for any scheme of training drawn up under regulation 19,
to submit himself to a medical examination.
Discharge
13.  Where a cadet is due to leave school, the officer-in-charge of the unit in which the cadet is enrolled under regulation 4 or to which the cadet is transferred under regulation 5 shall take the necessary steps to discharge him from the Corps unless the cadet has applied for permission to continue being a cadet under regulation 4(4).
Release of cadets
14.—(1)  The officer-in-charge of a unit to which a cadet belongs may approve an application by the cadet for his discharge from the Corps.
(2)  Where a cadet who applies for a discharge under paragraph (1) is a student of a school, the officer-in-charge of the unit to which the cadet belongs shall obtain the concurrence of the principal of the school to the release of the cadet before approving the application under paragraph (1).
National Police Cadet Corps Orders
15.  The Commandant may issue National Police Cadet Corps Orders from time to time which may contain all entries, appointments, promotions, awards, resignations and termination of service of officers and cadets and retirement from service of officers.
Rank structure and badges of ranks
16.  The Council shall decide on the rank structure of the Corps and the badges of rank to be worn by the officers and cadets, which, insofar as is practicable, shall resemble those of the Singapore Police Force.
Cadet Inspectors
17.—(1)  The rank of Cadet-Inspector shall be created by the Council.
(2)  An Examination Board shall be established to conduct examinations to determine whether any cadet is suitable for promotion to the rank of sergeant or corporal.
(3)  The Board established under paragraph (2) shall consist of not fewer than 3 persons, all of whom shall be appointed by the Commandant.
(4)  The Commandant may promote a cadet to the rank of sergeant or corporal if the cadet has passed such examinations as may be held by the Board established under paragraph (2), and where the cadet has successfully completed any course of training approved by the Commandant and is in a pre-university class, the Commandant may promote him to the rank of Cadet-Inspector.
(5)  The badge of rank of a Cadet-Inspector shall be the badge of a Probationary Inspector of the Singapore Police Force worn on each shoulder strap between the shoulder title and a white tape 25.4 millimetres wide running breadthwise across the shoulder strap.
(6)  The appointment of a Cadet-Inspector shall be terminated when he is discharged from the Corps.
Uniform
18.—(1)  The Council shall determine the uniform to be worn by all members of the Corps, which, insofar as is practicable, shall resemble that of the Police Force.
(2)  A member of the Corps shall be issued free of charge such uniforms and equipment as the Commandant may direct.
(3)  All uniforms and equipment issued to a member of the Corps under paragraph (2) shall remain the property of the Corps at all times.
(4)  A member of the Corps shall not wear his uniform except when he is on duty or undergoing training or is proceeding to or from the place of duty or training.
(5)  A person who ceases to be a member of the Corps shall return all uniforms and equipment issued to him under paragraph (2) and shall, unless the Commandant directs otherwise, pay for the cost of any uniform or equipment, or the replacement for any uniform or equipment, which he has failed to return.
(6)  The Commandant may refuse to accept any returned uniform or equipment which is in a damaged condition (fair wear and tear excepted) or accept the uniform or equipment on condition that the person returning it shall pay for the cost of the repair of or the replacement for the uniform or equipment.
Training and administration
19.—(1)  The Commandant shall be assisted in the training and administration of the Corps by such persons as are appointed by the Commissioner of Police and the Permanent Secretary to the Ministry of Education.
(2)  The Commandant shall be responsible for drawing up schemes of training and for the good order, discipline and welfare of members of the Corps.
(3)  The Commandant may, with the approval of the Council, make rules relating to awards in the form of badges and other insignia to cadets for proficiency in training and other achievements.
Appointment of officer-in-charge of unit
20.—(1)  The Commandant shall, acting upon the recommendation of the principal of the school in which a school unit is located or to which the unit is attached, appoint an officer-in-charge of the unit.
(2)  The appointment of an officer-in-charge of an open unit shall also be made by the Commandant.
Duties of officer-in-charge of unit
21.—(1)  An officer-in-charge of a unit shall be responsible to the Commandant for the discipline, training and welfare of that unit.
(2)  An officer-in-charge of a unit shall —
(a)keep a register showing the names and number of the officers and cadets in that unit;
(b)keep records of the attendance of those officers and cadets at parades;
(c)keep proper custody of all uniforms, accoutrements, stores, equipment and arms issued to the unit and keep records of those uniforms, accoutrements, stores, equipment and arms;
(d)ensure that training is carried out in accordance with such training syllabi as the Commandant may prepare and that all other activities as may from time to time be organised by the Commandant are carried out; and
(e)keep the officers and cadets informed of all rules, regulations, orders and instructions relating to the Corps.
Public funds
22.  All funds raised from the public may only be expended on such projects as may be approved by the Council.
Disciplinary action against cadets
23.—(1)  Where a cadet in a unit is to be dealt with under section 11 of the Act for any misconduct, act or omission, a report in writing stating the particulars of the alleged misconduct, act or omission and the witnesses to the alleged misconduct, act or omission shall be made by the officer in immediate command of the cadet to the officer-in-charge of the unit.
(2)  Where an officer-in-charge of a unit has made a complaint against a cadet in that unit for any misconduct, act or omission or who is a witness in any disciplinary proceedings against the cadet for any misconduct, act or omission he shall not deal with the cadet but shall report him to the Commandant who may deal with the cadet in accordance with regulation 24.
Commencement of investigations
24.—(1)  On receiving a report made pursuant to regulation 23(1) or (2) the officer-in-charge or the Commandant, as the case may be, shall as soon as practicable investigate into the alleged misconduct, act or omission.
(2)  Before the officer-in-charge or the Commandant investigates into any misconduct, act or omission under paragraph (1) the officer-in-charge or the Commandant, as the case may be, shall explain to the cadet whose misconduct, act or omission is being investigated into, the allegations made against him as stated in the report.
Manner of investigation
25.—(1)  An investigation under regulation 24(1) shall be conducted in an informal manner in the presence of the cadet whose misconduct, act or omission is investigated into; and the cadet shall be given an opportunity to answer all allegations made against him, call persons who can give evidence in support of his answers or cross-examine every witness and persons making the allegations.
(2)  Where an investigation under regulation 24(1) into any misconduct, act or omission by a cadet is completed, the officer-in-charge or the Commandant conducting the investigation may deal with the cadet in accordance with section 12 of the Act.
Report of incidents
26.—(1)  An officer-in-charge of a unit shall as soon as practicable report to the Commandant in such form as the Commandant may direct any incident resulting in any injury to or in the death of a member of the Corps in that unit if the injury or death arose out of or in the course of the member’s training or duty.
(2)  Where a report under paragraph (1) is made on an incident involving a cadet who is a student of a school, a copy of the report shall be submitted to the principal of the school.
Duty allowance for officers
27.—(1)  An officer, honorary officer or honorary instructor may be paid an allowance for attending a parade.
(2)  An allowance under paragraph (1) shall be paid at such rate as may be approved by the Council and published from time to time in the National Police Cadet Corps Orders issued under regulation 15.
Limitation
28.—(1)  Where there is more than one parade in a day, an allowance may be paid under regulation 27 as if there was only one parade on that day.
(2)  Where a parade in a day is continued on the following day by more than two hours, the continuation shall be regarded as another parade in the payment of an allowance under regulation 27.
Parade
29.  For the purposes of regulations 27 and 28, a parade shall include any training, annual camp, attendance at meetings or administrative duties of not less than two hours duration.
Special allowances
30.  The Council may authorise the payment of such special allowances as it thinks fit to any member, honorary officer and honorary instructor of the Corps.
Certificates
31.—(1)  A membership certificate shall be issued to a member of the Corps when he completes his term of service in the Corps.
(2)  No membership certificate shall be issued under paragraph (1) to a member of the Corps who is dismissed or whose services are terminated on account of any misconduct or for any other reason which in the opinion of —
(a)the Council, if the member is an officer; or
(b)the Commandant, if the member is a cadet.
renders such termination desirable.
(3)  A certificate may be issued to a member of the Corps who has successfully completed a specific course of training or such other activity as may be approved by the Council.
Assessment Board
32.—(1)  There shall be established an Assessment Board for the purpose of making recommendations to the Minister on the awards of compensation to be made to members or their dependants for any death or personal injury arising out of or in the execution of the duty of a member and which is attributable solely to the discharge of his duty.
(2)  The Assessment Board shall consist of —
(a)a representative from the Ministry of Education;
(b)a representative from the Ministry of Home Affairs;
(c)a representative from the Ministry of Finance;
(d)a representative from the Ministry of Health; and
(e)two other persons,
all of whom shall be appointed by the Minister.
(3)  The Minister shall appoint a member of the Assessment Board to be the Chairman thereof.
Reference to Assessment Board
33.—(1)  A member of the Corps who suffers any personal injury or the dependants of a member of the Corps who is killed may, within 3 months of the occurrence of the personal injury or death, make an application to the Commandant for an award of compensation by the Minister under section 14 of the Act if the injury or death arose out of or in the execution of the member’s duty and is attributable solely to the discharge of his duty as such member.
(2)  The Commandant shall upon receipt of an application under paragraph (1) forthwith refer the application to the Assessment Board which shall, after considering the application, forward to the Minister the Board's recommendations on the award of compensation to the member of the Corps or his dependants under section 14 of the Act.
(3)  The Council may consider an application made under paragraph (1) if the application is not made within the period of 3 months from the date of the occurrence of the personal injury or death suffered by the member of the Corps in respect of whom the application is made.
Funeral expenses
34.  Where a member of the Corps is killed and his death arose out of or in the execution of his duty and is attributable solely to the discharge of his duty, his dependants shall be entitled to be paid such funeral expenses, not exceeding $200, as the Minister, acting on the recommendation of the Assessment Board or otherwise, may determine.
Medical or hospital expenses
35.  Where a member of the Corps suffers any personal injury arising out of or in the execution of his duty and which is attributable solely to the discharge of his duty, and incurs medical or hospital expenses as a result of the personal injury, the Assessment Board may recommend to the Minister that the member be awarded compensation for those expenses in addition to any other award of compensation recommended by the Assessment Board under these Regulations.
