Presidential Elections (Composition of Offences) Regulations 2005

In exercise of the powers conferred by section 84(2) of the Presidential Elections Act, the Prime Minister hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Presidential Elections (Composition of Offences) Regulations 2005 and shall come into operation on 29th July 2005.

Compoundable offences

2. The following offences may be compounded by the Returning Officer, or any officer of the Elections Department who is authorised by the Returning Officer, in accordance with section 84(1) of the Act:

(a)	any offence under section 42C(1) or (2), 42E(2), 42F(2), 42G(1), 42H(1), 42I(1), 42M(2), 42N(2), 53(5), 60B(2), 60C(2), 64(1)(d) or (e) (read with subsection (3)), 67(2) or 83(2) of the Act; [S 447/2011 wef 02/08/2011] [S 269/2017 wef 01/06/2017] [S 473/2023 wef 01/07/2023]
(aa)	any corrupt practice under section 42(1)(c)(i) of the Act as in force immediately before 1 June 2023; [S 269/2017 wef 01/06/2017] [S 473/2023 wef 01/07/2023]
(ab)	any corrupt practice under section 42(1)(c)(ii) of the Act as in force immediately before 1 June 2023 read with regulation 1B of the Presidential Elections (Election Advertising) Regulations (Rg 3) revoked on 1 June 2023; [S 269/2017 wef 01/06/2017] [S 473/2023 wef 01/07/2023]
(ac)	any offence under section 60AA(2) of the Act as in force immediately before 1 June 2023 read with regulation 1C, 1D, 1E or 1F(2) of the Presidential Elections (Election Advertising) Regulations revoked on 1 June 2023, as the case may be; [S 269/2017 wef 01/06/2017] [S 473/2023 wef 01/07/2023]
(ad)	any offence under section 60A(3) of the Act as in force immediately before 1 June 2023; [S 473/2023 wef 01/07/2023]
(b)	any illegal practice under section 56(3) read with section 61 of the Act for failing to transmit, within the time limited by section 56(1) of the Act, the returns and statements respecting election expenses; [S 473/2023 wef 01/07/2023]
(ba)	any corrupt practice under section 42B(1) or (2) of the Act; [S 473/2023 wef 01/07/2023]
(c)	any offence under regulation 14A(1) or 16(a), (b) or (c) of the Presidential Elections (Election Advertising) Regulations revoked on 1 June 2023; [S 269/2017 wef 01/06/2017] [S 473/2023 wef 01/07/2023]
(d)	any offence under regulation 9(4), 10(1), 11(2) or 13(4) of the Presidential Elections (Election Advertising) Regulations 2023 (G.N. No. S 470/2023). [S 473/2023 wef 01/07/2023]
