Citation
1.  These By-laws may be cited as the Town Council of Tanjong Pagar-West Coast (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws.
Calculation of penalties and administrative fee for conservancy and service charges or licence fee in arrears
2.—(1)  Where any conservancy and service charge or licence fee payable in respect of any commercial or communal property by any tenant, owner or licensee, as the case may be, to the Town Council of Tanjong Pagar-West Coast is in arrears, the tenant, owner or licensee shall be liable to pay to the Town Council —
(a)a penalty determined in accordance with paragraph (2) for every month in which any conservancy and service charge or licence fee is in arrears, and such penalty shall be payable on the last day of such month; and
(b)in respect of the first month in which any conservancy and service charge or any licence fee is due and unpaid, an administrative fee of $2.
(2)  Where the total accumulated amount of conservancy and service charges or licence fees in arrears on the last day of a month is within any range of charges or fees in arrears set out in the first column of the Schedule, the penalty payable under paragraph (1) (a) shall be the amount specified in the second column of the Schedule opposite to that range.
(3)  The administrative fee in paragraph (1) (b) shall be payable only once so long as the conservancy and service charges or licence fees, as the case may be, are or continue to be in arrears.
(4)  In paragraph (1) (b), “first month” means the first month following a period of at least one month where the conservancy and service charges or licence fee, as the case may be, are not in arrears.
Administrative fee
3.—(1)  Where any conservancy and service charge or licence fee or any part thereof due to the Town Council remains unpaid for a period of 6 months or more from the date on which it was due, the tenant, owner or licensee liable for such charge or fee shall, in addition to any penalty which may be imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $50 and disbursement fee of $10.
(2)  The administrative fee of $50 referred to in paragraph (1) shall be payable only once so long as the conservancy and service charge, licence fee or any part thereof remains unpaid.
Recovery of licence fees
4.  Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council in respect of any antecedent breach by the licensee under any licence agreement entered into between the Town Council and the licensee.
Application of payment
5.  The Town Council may, in its discretion, apply any moneys paid by the tenant, owner or licensee firstly towards the payment of the amount of any penalty and administrative fee payable under these By-laws and subsequently apply any balance thereof towards payment of any amount of outstanding conservancy and service charges or licence fees.
Remission
6.  The Town Council may, in its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
