Citation
1.  These By-laws may be cited as the Town Council of Jurong (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws.
Calculation of penalty for conservancy and service charge or licence fee in arrears
2.—(1)  Where on the last day of any month any conservancy and service charge or licence fee payable by any tenant, owner or licensee, as the case may be, to the Town Council of Jurong is in arrears, the tenant, owner or licensee shall be liable to pay to the Town Council a penalty at the rate of one per cent of the amount of the arrears, subject to a minimum of two dollars.
(2)  In calculating the amount of penalty payable by a tenant, owner or licensee under paragraph (1), a fraction of a dollar which is less than 50 cents shall be rounded off as 50 cents, and a fraction of a dollar which is more than 50 cents shall be rounded off to the nearest dollar.
Administrative fee for conservancy and service charge, licence fee or penalty which remains unpaid for more than 6 months
3.—(1)  Where any conservancy and service charge, licence fee, penalty or any part thereof remains unpaid for a period exceeding 6 months from the date on which it was due to be paid, the tenant, owner or licensee shall, in addition to any penalty which may be further imposed under by-law 2, be liable to pay to the Town Council and administrative fee of $50.
(2)  The administrative fee of $50 referred to in paragraph (1) shall be payable only once so long as the conservancy and service charge, licence fee, penalty or any part thereof remains unpaid.
Recovery of moneys under licence agreement
4.  Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council under any licence agreement entered into between the Town Council and any licensee.
Application of payment
5.  The Town Council may, in its discretion, apply any moneys paid by a tenant, owner or licensee under these By-laws firstly towards the payment of the amount of any penalty or administrative fee payable under these By-laws and thereafter apply any balance of such moneys towards the payment of the amount of conservancy and service charge, licence fee or any part thereof which remains in arrears.
Remission
6.  The Town Council may, in its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
