Citation

1. These By-laws may be cited as the Town Council of Potong Pasir (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws.

Calculation of penalties for conservancy and service charge or licence fee in arrears

2.—(1) Where any conservancy and service charges payable by the tenant or owner to the Town Council of Potong Pasir are in arrears for one month or more, the tenant or owner shall be liable to pay to the Town Council the following penalty for every month in which there is an arrear:

(a)	in the case of a tenant or owner of any type of residential or commercial property specified in the first column of the Schedule, the penalty payable shall be the amount specified in the second column of the Schedule opposite to that type of property; or
(b)	in the case of a tenant or owner of other commercial property, the penalty payable shall be 15% of the amount of arrears on the last day of every month in which there is an arrear,

and the penalty shall become due and payable on the day following the expiry of the month in which there is an arrear.

(2) Where any licence fee payable by any licensee to the Town Council of Potong Pasir is in arrears on the last day of any month in respect of which such fee is payable, the licensee shall be liable to pay to the Town Council a penalty of 10% of the amount of arrears on that day or $2, whichever is the higher, and the penalty shall become due and payable on the day following the expiry of that month.

(3) In calculating the amount of penalty payable by the tenant or licensee, the arrears payable shall be rounded off to the nearest dollar except that where the fraction of a dollar is 50 cents, it shall be regarded as a dollar.

Administrative fee

3.—(1) Where any conservancy and service charge, licence fee, penalty or any part thereof remains unpaid for a period exceeding 6 months from the date on which it was due to be paid, the tenant, owner or licensee shall be liable to pay to the Town Council of Potong Pasir an administrative fee of $50.

(2) The administrative fee referred to in paragraph (1) shall be payable only once so long as the conservancy and service charge, licence fee, penalty or any part thereof remains unpaid.

Recovery of moneys under licence agreement

4. Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council under any licence agreement entered into between the Town Council and any licensee.

Application of payment

5. The Town Council may, in its discretion, apply any moneys paid by a tenant, owner or licensee under these By-laws firstly towards the payment of the amount of any penalty or administrative fee payable under these By-laws and thereafter apply any balance of such moneys towards the payment of any amount of conservancy and service charges or licence fees in arrears.

Remission

6. The Town Council may, it its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
