Tobacco (Control of Advertisements and Sale)
(Specified Premises — Exemption) Order 2017
In exercise of the powers conferred by section 22 of the Tobacco (Control of Advertisements and Sale) Act, the Minister for Health makes the following Order:
Citation and commencement
1.  This Order is the Tobacco (Control of Advertisements and Sale) (Specified Premises — Exemption) Order 2017 and comes into operation on 1 January 2018.
Definitions
2.  In this Order —
“import and wholesale licensee” means the holder of an import and wholesale licence mentioned in section 18(1) or (2) of the Act;
“retail licensee” means the holder of a retail licence mentioned in section 18(3) of the Act;
“specified premises”, in relation to a licence, means the premises specified in the licence.
Exemption
3.—(1)  Section 18(4)(a) of the Act does not apply to an import and wholesale licensee that does any of the following at premises other than specified premises:
(a)distributes by wholesale any tobacco product;
(b)sells or offers for sale by wholesale any tobacco product;
(c)permits to be sold or offered for sale by wholesale any tobacco product;
(d)has in the licensee’s possession any tobacco product for sale by wholesale,
if those premises are authorised premises.
(2)  For the purposes of sub‑paragraph (1), the authorised premises are —
(a)in the case of a supply to another import and wholesale licensee, the premises specified in that other licensee’s licence; or
(b)in the case of a supply to a retail licensee, the premises specified in the retail licensee’s licence.
(3)  Regulation 11(1) of the Tobacco (Control of Advertisements and Sale) (Licensing) Regulations 2017 (G.N. No. S 763/2017) does not apply to an import and wholesale licensee that stores or places, or causes to be stored or placed, at the authorised premises mentioned in sub‑paragraph (2), any tobacco product that the licensee intends to distribute or sell by wholesale at those premises.
