Weights and Measures (Prescribed Quantities of Pre-packed Goods for Sale by Retail) Order

Citation

1. This Order may be cited as the Weights and Measures (Prescribed Quantities of Pre-packed Goods for Sale by Retail) Order.

Goods prepacked for retail sale to be marked in metric units. Non-metric units may, in addition, be marked

2.—(1) Where the goods described in the first column of the Schedule have been pre-packed for sale by retail they shall be sold in the quantities specified in the second column of the Schedule.

(2) The containers in which any of those goods have been pre-packed for sale by retail or for delivery after sale shall be marked in a conspicuous position with information in metric units regarding the net quantities of the goods in the containers. The net quantities of the goods may, in addition, be marked in non-metric units.

Where net quantities of such goods are marked on containers, they should be in metric units

3. Paragraph 2 shall not apply where the goods described in the first column of the Schedule have been pre-packed for sale by retail in quantities outside the range specified in the third column of the Schedule, except that where the net quantities of the goods are marked on the containers they shall be expressed in metric units. The net quantities of the goods may, in addition, be marked in non-metric units.

Order not to apply to goods sold at auction, etc.

4. This Order shall not apply to the sale of goods —

(a)	at an auction or under a tender system;
(b)	when sold in bulk;
(c)	for use in trade or industry;
(d)	on board a train, ship or aircraft; and
(e)	which are returned by importing countries.

Exemption

5. The Minister may exempt any goods from all or any of the provisions of this Order.

Penalty

6. Any person who contravenes or fails to comply with paragraph 2 or 3 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $500.
