Regulations 2022

In exercise of the powers conferred by section 49 of the Building Control Act 1989, the Minister for National Development makes the following Regulations:

Citation and commencement

1. These Regulations are the Building Control (Regulating Fixed Installation Contractors) Regulations 2022 and come into operation on 9 December 2022.

Prescribed date

2. The date prescribed for the definition of “prescribed date” in section 29M of the Act is 9 December 2022.

Application fee for registration

3.—(1) The respective application fees for or to renew a registration are specified in the Schedule.

(2) In addition, a late renewal application as described in section 29O(3)(b) of the Act must be accompanied by a fee of $100.

Period before date of expiry of registration to apply for renewal

4. The prescribed period under section 29O(3)(b) of the Act is one month.

Pay slip

5.—(1) The pay slip mentioned in section 29Q(1)(b) of the Act for every citizen or permanent resident of Singapore who is employed or is to be employed by the person registered under Part 5B of the Act (called an employee) must contain particulars of the amount of the following payments received by the employee from the registered person:

(a)	the basic wage;
(b)	any overtime payment;
(c)	any sum by way of reimbursement to the employee for special expenses incurred during his or her employment;
(d)	any allowance however described;
(e)	any progressive wage model bonus (as defined in section 29M of the Act).

(2) Subject to paragraph (3), the pay slip mentioned in section 29Q(1)(b) of the Act must be issued at the following frequency:

(a)	if the pay slip is a single pay slip relating solely to one salary period — at least once during the salary period;
(b)	if the pay slip is a consolidated pay slip relating to 2 or more salary periods, at least once a month.

(3) Where an employee’s employment with a registered person ends, a pay slip that relates to all salary periods for which a pay slip was earlier not issued must then be issued once between —

(a)	the salary payment date relating to the last salary period preceding the end of employment; and
(b)	the employee’s last day of employment with the employer,

both dates inclusive.

(4) In this regulation, “salary period” means —

(a)	a period (not exceeding one month) fixed by the employer in respect of which salary earned by the employee is payable; or
(b)	if the employer does not fix a period under sub‑paragraph (a), a period of one month.

Appeal against regulatory action

6.—(1) A person aggrieved by a decision by the Building and Construction Authority to cancel a registration, or to take a regulatory action, which is specified in a notice under section 29R(5) of the Act may appeal to the Minister against the decision by filing, with the Permanent Secretary, Ministry of National Development, an appeal in accordance with paragraph (2).

(2) The appeal —

(a)

must be filed within 14 days after the date of receipt of the notice;

(b)

must contain —

(i)	a summary of the grounds of the appeal; and
(ii)	a succinct presentation of the appellant’s arguments of fact or law supporting each ground of appeal; and

(c)

must be accompanied by a copy of —

(i)	the notice;
(ii)	any other correspondence between the appellant and the Building and Construction Authority related to the decision that the appellant is appealing against; and
(iii)	any other document supporting a ground of appeal and argument of fact or law.
