Citation
1.  These Regulations may be cited as the Charities (Sector Administrators) Regulations.
Functions and powers in relation to charities
2.—(1)  The Commissioner may delegate to any Sector Administrator any function or power under the Act in relation to charities, except those that are exercisable under sections 22, 23, 24, 26, 27 and 31 of the Act.

(2)  A delegation under paragraph (1) shall be in writing.
(3)  The Sector Administrator shall exercise any function or power delegated under paragraph (1) only in relation to charities within its sector.
(4)  The exercise of any such function or power by the Sector Administrator —
(a)shall be subject to such conditions and directions as the Commissioner may specify; and
(b)shall not prevent the exercise of any function or power by the Commissioner.
Approval and supervision of institutions of a public character
3.—(1)  A Sector Administrator may approve any institution within its sector as an institution of a public character.
(2)  Such approval shall be made in accordance with —
(a)these Regulations;
(b)the Charities (Institutions of a Public Character) Regulations (Rg 5); and
(c)any conditions or directions as the Commissioner may specify.
(3)  Such approval shall be made only by an officer of the Sector Administrator who is holding an office not lower than that of a director.
(4)  A Sector Administrator shall ensure that every institution of a public character approved by it —
(a)complies with regulation 11 of the Charities (Institutions of a Public Character) Regulations in the use of any donation received by that institution of a public character; and
(b)maintains donation records and accounting records in accordance with regulations 10 and 12 of the Charities (Institutions of a Public Character) Regulations.
Submission of information to Commissioner
4.  A Sector Administrator shall furnish to the Commissioner, in such form and at such times as the Commissioner may require —
(a)the name of every charity registered by the Sector Administrator;
(b)the name of every institution of a public character approved by the Sector Administrator; and
(c)such other information that the Commissioner may require in respect of any charity registered by the Sector Administrator or any institution of a public character approved by the Sector Administrator.
Appeals against decisions of Sector Administrators
5.—(1)  A charity, institution of a public character or person that is affected by any decision of a Sector Administrator may appeal to the Commissioner against that decision.
(2)  The Commissioner may affirm, vary, substitute or annul any decision of a Sector Administrator.
