Electricity (Cable Detection Workers) Regulations

Citation
1.  These Regulations may be cited as the Electricity (Cable Detection Workers) Regulations.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“approved courses webpage” means the Internet webpage, accessible through a hyperlink on the Internet website known as ELISE, on which the Authority specifies the courses of instruction to be completed by a person in connection with a licence;

“licence” means a licence granted by the Authority permitting a person to perform such cable detection work as is specified in the licence;
“licensee” means any person who has a valid licence;
“register” means the register of licensees maintained under regulation 12;

“relevant experience” means practical experience in Singapore in any of the following areas:
(a)building construction;
(b)building services;
(c)civil engineering;
(d)structural engineering construction.

Qualifications
3.  A licence may be granted to any person who —
(a)satisfies the Authority that he —
(i)possesses a diploma majoring in engineering, architecture, building, land surveying or any other discipline relevant to the construction of structures, or such other qualification as may be acceptable to the Authority;
(ii)has not less than 2 years relevant experience; and
(iii)has successfully completed a course of instruction specified on the approved courses webpage that is relevant to cable detection work;
(b)satisfies the Authority that he —
(i)possesses a National Institute of Technical Education Certificate majoring in engineering, architecture, building, land surveying or any other discipline relevant to the construction of structures, or such other qualification as may be acceptable to the Authority;
(ii)has not less than 5 years relevant experience; and
(iii)has successfully completed a course of instruction specified on the approved courses webpage that is relevant to cable detection work; or
(c)satisfies the Authority that he —
(i)possesses a Workplace Literacy and Numeracy (Level 5) Certificate under the Singapore Workforce Skills Qualifications framework, or such other qualification as may be acceptable to the Authority;
(ii)has not less than 10 years relevant experience; and
(iii)has successfully completed a course of instruction specified on the approved courses webpage that is relevant to cable detection work.

Application for licence or renewal of licence
4.—(1)  An application for a licence or renewal of a licence shall be made to the Authority in such form as may be provided by the Authority and shall be accompanied by the appropriate fee specified in the Schedule and such documents and information in support of the application as the Authority may require.
(2)  An application for the renewal of a licence shall be submitted to the Authority not later than one month prior to the date of expiry of the licence.
(3)  The Authority may, in its discretion, reject an application for a licence or a renewal of a licence from any person whose licence was previously cancelled or suspended.
Licence subject to conditions, etc.
5.—(1)  Where the Authority approves an application for a licence or renewal of a licence, the Authority shall grant the licence to the applicant upon payment by him of the appropriate fee specified in the Schedule.
(2)  A licence granted by the Authority shall be —
(a)valid for such period as may be specified therein unless it is earlier cancelled or suspended in accordance with these Regulations; and
(b)subject to such conditions as the Authority may, from time to time, determine.
Duties of licensee
6.  In addition to the obligations imposed under his licence and the Act, every licensee shall —
(a)carry out such cable detection work as he is permitted to carry out under his licence in accordance with such guidelines as may be issued from time to time by the Authority, any other public or statutory authority or any transmission licensee;
(b)on being required by the Authority or a transmission licensee or any person authorised by the Authority or the transmission licensee for this purpose, produce his licence for examination or furnish information relating to his performance of any cable detection work;
(c)immediately inform any transmission licensee by the quickest practicable means of any damage to any electricity cable belonging to or under the management of or control of the transmission licensee if he knows or ought reasonably to know of the damage;
(d)immediately inform the Authority in writing of any change in his address; and
(e)attend at such place as the Authority or any person authorised by the Authority may specify to produce such document or furnish such information as the Authority or authorised person may specify for the purpose of ensuring compliance with the Act.
Tests and examinations
7.  The Authority may, for the purpose of ensuring that any licensee will carry out cable detection work competently, at any time by notice in writing require the licensee to attend at a time and place specified in the notice to take and successfully complete such test or examination as the Authority may approve.
Cancellation, suspension, etc., of licence
8.—(1)  In addition to any penalty which may be imposed under these Regulations or otherwise, if a licensee —
(a)has obtained his licence by making or causing to be made or produced any false or fraudulent declaration, certificate or representation, either in writing or otherwise;
(b)has, in the opinion of the Authority, contravened any provision of these Regulations or any condition of the licence granted to him;
(c)has committed an offence under the Act or of any other offence which offence is of such nature as to render it, in the opinion of the Authority, undesirable that he should continue to hold the licence;
(d)having been given notice under regulation 7 to attend at a specified time and place to be tested for competence, has failed to attend to be tested or to pass such test as may be required by the Authority to prove his competence to hold a licence;
(e)is, in the opinion of the Authority, incapable of carrying out the cable detection work in respect of which his licence was granted;
(f)has applied for the cancellation of his licence;
(g)is for some other reason unfit to be licensed or to continue to be licensed; or
(h)has, in the performance of any cable detection work, failed to comply with the guidelines issued by the Authority, any other public or statutory authority or any transmission licensee,
the Authority may, notwithstanding that the licence has been granted or renewed since the occurrence of the relevant event, cancel or refuse to renew the licence, or suspend the licence for such period as the Authority thinks fit.
(2)  No compensation shall be paid by the Authority to any person whose licence is cancelled or suspended and no fee or part of the fee shall be refunded by the Authority to that person in respect of the unexpired period of such licence.
(3)  Without prejudice to paragraph (1), where the Authority is satisfied in any case that a licensee has failed to carry out his duties as a cable detection worker in a safe, careful or proper manner, the Authority may order the licensee to undergo a period of retraining not exceeding 12 months and suspend his licence until that period of retraining has been completed to the satisfaction of the Authority.
Reduction of period of suspension
9.  The Authority may, at any time and for such reason as it thinks sufficient, reduce the period for which the licence of a cable detection worker has been suspended under regulation 8.
Surrender of cancelled or suspended licence
10.  If any licence is cancelled or suspended, every person who has in his possession the licence or replacement licence thereof shall, within 14 days of the date of cancellation or suspension, surrender the licence or replacement licence to the Authority.
Replacement licence
11.  If the Authority is satisfied that any licence granted by it under these Regulations has been lost, destroyed or defaced, the Authority may, upon payment of the appropriate fee specified in the Schedule, grant a replacement licence.
Register
12.  The Authority shall maintain a register of licensed cable detection workers which shall contain the following particulars:
(a)the full name and address of every licensee as set out in his application form for the licence;
(b)the date of grant and expiry, and the number, of the licence issued to him;
(c) the date of any conviction of any offence under the Act;
(d) any cancellation or suspension of, or refusal to renew, any licence granted to him; and
(e) such other particulars as the Authority thinks fit.
Information from register
13.  The Authority shall, upon the request of any person and accompanied by the appropriate fee specified in the Schedule, furnish information to that person in writing as to whether or not any person is a licensed cable detection worker.
Penalties
14.  Any person who —
(a)fails to comply with regulation 6(b), (c), (d) or (e); or
(b)fails to surrender any licence to the Authority as required under regulation 10,
shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 and, in the case of a continuing offence, to a further fine not exceeding $250 for every day or part thereof during which the offence continues after conviction.
