Environmental Public Health
(Specified Construction Sites)
Order 2021
In exercise of the powers conferred by section 62(1) of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Order:
Citation and commencement
1.  This Order is the Environmental Public Health (Specified Construction Sites) Order 2021 and comes into operation on 30 September 2021.
Definitions
2.  In this Order, unless the context otherwise requires —
“contract sum”, in relation to a construction site, means the total value specified in a contract for works carried out or to be carried out on the construction site (including any goods and services tax chargeable under the Goods and Services Tax Act (Cap. 117A) on the supply of the works);
“week” means a continuous period of 7 days;
“works”, in relation to a construction site, means —
(a)the erection, construction, alteration, repair or maintenance of buildings, structures or roads;
(b)the breaking up or opening of, or boring under, any road or adjacent land in connection with the construction, inspection, maintenance or removal of works;
(c)demolition or dredging works; or
(d)any other work of engineering construction.
Specified construction site
3.  Section 62 of the Act applies to any construction site, the contract sum in relation to which exceeds $10 million (called in this Order a specified construction site).
Appointment of Environmental Control Officer for specified construction site
4.—(1)  A registered Environmental Control Officer required to be appointed for a specified construction site under section 62(2) or (2A) of the Act —
(a)where the contract sum for the specified construction site exceeds $50 million — must be appointed on a full‑time basis; or
(b)where the contract sum for the specified construction site exceeds $10 million but does not exceed $50 million — may be appointed on a part‑time basis or full‑time basis.
(2)  In this paragraph —
“full‑time basis”, for the appointment of a registered Environmental Control Officer for a specified construction site, means the appointment of the Environmental Control Officer to carry out his or her function as such for the specified construction site for at least 40 hours per week;
“part‑time basis”, for the appointment of a registered Environmental Control Officer for a specified construction site, means the appointment of the Environmental Control Officer to carry out his or her function as such for the specified construction site for at least 15 hours per week.
Revocation
5.  The Environmental Public Health (Appointment of Environmental Control Officers) Order (O 1) is revoked.
