(Meranti Power Pte. Ltd. — Exemption)
Order 2025
In exercise of the powers conferred by section 75 of the Environmental Protection and Management Act 1999, the National Environment Agency makes the following Order:
Citation and commencement
1.  This Order is the Environmental Protection and Management (Meranti Power Pte. Ltd. — Exemption) Order 2025 and comes into operation on 15 February 2025.
Definitions
2.  In this Order —
“aggregate duration where permissible noise levels are exceeded”, in relation to any period, means an aggregate duration of occasions in the exempted sessions of that period when the noise levels emitted from the relevant premises exceed the permissible noise levels;
“Boundary Noise Limits Regulations” means the Environmental Protection and Management (Boundary Noise Limits for Factory Premises) Regulations (Rg 1);
“exempted session” means any of the following:
(a)between 12 a.m. and 6.59 a.m. of any day;
(b)between 7 p.m. and 11.59 p.m. of any day;
“permissible noise levels” means the maximum permissible noise levels prescribed in regulation 3(1)(b), subject to regulation 3(3), of the Boundary Noise Limits Regulations;
“relevant premises” means the factory premises located at 3 Meranti Road, Singapore 628536;
“specified 12‑month period” means the period starting from 1 July 2025 and ending on 30 June 2026 (both dates inclusive) and each subsequent period of 12 months starting on 1 July of a year and ending on 30 June of the succeeding year.
Exemption
3.—(1)  Meranti Power Pte. Ltd. is exempt from regulation 3(1)(b) of the Boundary Noise Limits Regulations, in respect of the relevant premises during an exempted session of any day.
(2)  The exemption in sub‑paragraph (1) ceases to apply at any of the following times, whichever first occurs:
(a)when, in the period from 15 February 2025 to 30 June 2025 (both dates inclusive), the aggregate duration where permissible noise levels are exceeded at the relevant premises exceeds 1,000 hours;
(b)if, in any specified 12‑month period, the aggregate duration where permissible noise levels are exceeded at the relevant premises exceeds 700 hours, upon the expiry of a period of 12 months commencing on the first day of the month immediately after the month in which the aggregate duration of 700 hours is exceeded;

The relevant specified 12‑month period is 1 July 2025 to 30 June 2026 (both dates inclusive). On 15 March 2026, at 10 p.m., the aggregate duration where permissible noise levels are exceeded goes beyond 700 hours. The exemption ceases to apply from and including 1 April 2027.
(c)when, at any time during an exempted session of any day on or after 15 February 2025 —
(i)the noise levels emitted from the relevant premises measured has, over a period of 5 minutes at any point at or about ground level along a boundary of the relevant premises set out in the first column of the Schedule, exceeded the maximum boundary noise levels set out for the corresponding time for that boundary in the second column (read with sub‑paragraph (3)); or
(ii)if any permissible noise level is exceeded, the testing and commissioning or operating of the Open Cycle Gas Turbine Generating Station (or any part thereof) located on the relevant premises is not the only source of noise from the relevant premises.
(3)  If there are other sources of noise affecting the measurement of the level of noise emitted from the relevant premises, the maximum boundary noise levels set out in the Schedule are to be adjusted in accordance with regulation 3(3) of, and the Second Schedule to, the Boundary Noise Limits Regulations as if a reference in those provisions to the maximum permissible noise levels set out in the First Schedule to those Regulations is a reference to the maximum boundary noise levels set out in the Schedule.
