(Exemption for 3-door Omnibus) Order 2019

In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport makes the following Order:

Citation and commencement

1. This Order is the Road Traffic (Motor Vehicles, Construction and Use) (Exemption for 3‑door Omnibus) Order 2019 and comes into operation on 24 April 2019.

Definition

2. In this Order, “3‑door omnibus” means an omnibus that has 3 sets of entrance and exit doors for passengers to board and disembark.

Exemption

3.—(1) Subject to sub-paragraph (2), rules 6(1), 44(1), 60(1) and 77(1)(d) and (e) of the Road Traffic (Motor Vehicles, Construction and Use) Rules (R 9) do not apply to a 3‑door omnibus that is owned by the Authority.

(2) The exemption in sub-paragraph (1) is subject to the condition that there must be in force, at all times, a policy of insurance in relation to the 3‑door omnibus insuring against any liability in respect of —

(a)	damage to any property caused by or arising out of the use of that 3‑door omnibus; and
(b)	the death of, or bodily injury sustained by, any person caused by or arising out of the use of that 3‑door omnibus.
