Citation

1. These Regulations may be cited as the Singapore Polytechnic (Students) (Conduct and Discipline) Regulations.

Definitions

2. In these Regulations, unless the context otherwise requires —

“appeal committee” means the committee appointed by the Board under regulation 9(2);

“disciplinary offence” means —

(a)	any contravention of any provision of the Singapore Polytechnic (Students’ Union) Regulations (Rg 1) or the Singapore Polytechnic (Clubs) Regulations (Rg 2); or
(b)	any other act, conduct or neglect to the prejudice of good order or discipline;

“Principal” means the Principal of the Polytechnic;

“student” means a student of the Polytechnic, but does not include a member of the staff of the Polytechnic who is pursuing a course of study at the Polytechnic.

Student Disciplinary Committee

3.—(1) There shall be a Student Disciplinary Committee which shall comprise —

(a)	a Deputy Principal of the Polytechnic appointed by the Principal to be the Chairman of the Student Disciplinary Committee; and
(b)	4 other members appointed by the Principal from among the staff of the Polytechnic for such period as the Principal may determine.

(2) In the absence of the Deputy Principal referred to in paragraph (1)(a), another member appointed by the Principal shall act as Chairman.

(3) The Registrar of the Polytechnic or his representative shall be the secretary of the Student Disciplinary Committee.

(4) Three members of the Student Disciplinary Committee shall form a quorum.

(5) A decision of the Student Disciplinary Committee shall be made by a majority of the members present and voting and, in the event of an equality of votes, the Chairman shall have a casting vote.

(6) The Student Disciplinary Committee may act notwithstanding any vacancy in its membership.

(7) The Student Disciplinary Committee shall not be bound to act in a formal manner and may determine its own procedures.

(8) The Student Disciplinary Committee shall not be bound by the provisions of the Evidence Act (Cap. 97) or by any other law relating to evidence, and may inform itself on any matter in such manner as it thinks fit.

Disciplinary rules

4. The Principal may, from time to time, issue disciplinary rules for the maintenance and enforcement of discipline among the students.

Investigation

5.—(1) If it is reported to the Principal that a student has committed a disciplinary offence, the Principal may appoint a member of the staff of the Polytechnic to investigate into the allegation and to submit a report to him.

(2) The Principal shall, after considering the report submitted under paragraph (1), decide whether —

(a)

any further investigation is necessary;

(b)

the student concerned should, after having been given a reasonable opportunity of being heard —

(i)	be assigned work relating to his course of study; or
(ii)	be fined a sum not exceeding $250; or

(c)

there should be an inquiry by the Student Disciplinary Committee.

(3) Where it is decided that there should be an inquiry by the Student Disciplinary Committee, the Principal may, pending such inquiry, suspend the student from pursuing his studies in the Polytechnic until the matter has been dealt with by the Student Disciplinary Committee.

Inquiry

6.—(1) Before the Student Disciplinary Committee begins an inquiry into an alleged disciplinary offence, it shall send the student concerned a notice of the charge with such particulars as may be necessary to disclose the nature of the offence.

(2) The student may, within 7 days from the date of the notice, exculpate himself in writing and inform the Student Disciplinary Committee whether he wishes to attend the inquiry.

(3) The Student Disciplinary Committee shall give the student a reasonable opportunity of being heard at the inquiry.

(4) The Student Disciplinary Committee may receive all oral and written evidence which it considers relevant to the inquiry.

(5) At the conclusion of the inquiry, the Student Disciplinary Committee may —

(a)	recommend to the Principal that the student be expelled from the Polytechnic;
(b)	suspend the student from any course or subject, or bar the student from any examination, either permanently or temporarily;
(c)	assign the student work relating to his course of study;
(d)	impose a fine not exceeding $250; or
(e)	deprive the student of a pass in any examination or series of examinations or part thereof which relates to the disciplinary offence which the student has been found to have committed.

(6) If the Principal accepts the recommendation of the Student Disciplinary Committee to expel the student from the Polytechnic, the Principal may expel the student with effect from such date as he may determine.

(7) If the Principal rejects the recommendation of the Student Disciplinary Committee to expel any student from the Polytechnic, the Student Disciplinary Committee may impose any other punishment specified in paragraph (5) as it considers appropriate.

Payment of fines

7.—(1) Unless the Principal otherwise directs, any fine imposed under regulation 5(2)(b)(ii) or 6(5)(d) shall be paid to the Bursar of the Polytechnic within 7 days after it is imposed.

(2) Where a student fails to comply with paragraph (1), the Principal may take such action as he thinks fit.

Appeal to Principal

8.—(1) A student who has been suspended from the Polytechnic under regulation 6(5)(b) may appeal to the Principal in writing within 14 days stating any ground of appeal.

(2) The Principal may, after giving the student a reasonable opportunity of being heard, and after considering any report of the Student Disciplinary Committee, confirm, vary or quash the order of suspension imposed by the Student Disciplinary Committee.

(3) Pending a decision on any appeal made under this regulation, the student shall comply with the order of suspension against which the appeal is made.

(4) Any decision made by the Principal upon an appeal by a student under this regulation shall be final.

Appeal to Board

9.—(1) A student who has been expelled from the Polytechnic under regulation 6(6) may appeal to the Board in writing within 14 days stating any ground of appeal.

(2) The Board shall appoint an appeal committee comprising any 3 of its members to consider any appeal made under this regulation.

(3) The appeal committee may, after giving the student a reasonable opportunity of being heard, and after considering any report of the Student Disciplinary Committee, confirm, vary or quash the order of expulsion imposed by the Principal.

(4) Pending a decision on any appeal made under this regulation, the student shall comply with the order of expulsion against which the appeal is made.

(5) Any decision made by the appeal committee upon an appeal by a student under this regulation shall be final.
