Citation
1.  These By-laws may be cited as the Town Council of Marine Parade (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws.
Calculation of penalties for conservancy and service charges in arrears
2.  Where any conservancy and service charge payable by any tenant or owner to the Town Council of Marine Parade is in arrears, the tenant or owner shall be liable to pay for every month in which there is an arrear a penalty at the appropriate rate set out in the Schedule.
Administrative fee
3.—(1)  Where any conservancy and service charge, licence fee, penalty or any part thereof remains unpaid for a period exceeding 6 months from the date on which it was due to be paid, the tenant, owner or licensee shall, in addition to any penalty which may be further imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $50.
(2)  The administrative fee of $50 referred to in paragraph (1) shall be payable only once so long as the conservancy and service charge, licence fee, penalty or any part thereof remains unpaid.
Right of action or other remedy
4.  Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council under any licence agreement entered into between the Town Council and any licensee.
Application of payment
5.  The Town Council may, in its discretion, apply any moneys paid by the tenant or owner firstly towards the payment of the amount of any penalty payable under these By-laws and subsequently apply any balance thereof towards payment of any amount of outstanding conservancy and service charges.
Remission
6.  The Town Council may, in its discretion, remit wholly or in part any penalty payable under these By-laws.
