Weights and Measures
(Defences under Section 19)
Regulations 2022
In exercise of the powers conferred by section 37 of the Weights and Measures Act 1975, the Minister for Trade and Industry makes the following Regulations:
Citation and commencement
1.  These Regulations are the Weights and Measures (Defences under Section 19) Regulations 2022 and come into operation on 21 November 2022.
Inadequate packages and non-standard packages
2.  For the purpose of the definitions of “inadequate package” and “non‑standard package” in section 2(1) of the Act, the prescribed amounts of error are as specified in the First Schedule.
Conditions under section 19(5) of Act
3.—(1)  For the purpose of section 19(5)(b) of the Act, the conditions that the lot of packages is required to meet are as follows:
(a)the number of non-standard packages in a sample of packages taken from the lot of packages is equal to or less than the number of non‑standard packages allowed for the sample;
(b)there are no inadequate packages in the sample.
(2)  For the purpose of paragraph (1)(a), in determining the size of the sample to be taken from a lot of packages and the number of non‑standard packages allowed for the sample —
(a)where the number of packages in the lot of packages is fewer than 100, the sampling plan in Table 1 in the Second Schedule is to be applied; and
(b)in any other case, any of the sampling plans in the Second Schedule may be applied.
Conditions under section 19(6) of Act
4.—(1)  For the purpose of section 19(6)(a)(i) of the Act, in determining if the weighed average quantity of any sample of packages taken from a lot of packages equals to or exceeds the quantity stated on the package or label attached to it —
(a)the sampling plan in Table 1 in the Second Schedule is to be applied; and
(b)the weighed average quantity equals to or exceeds the quantity stated on the package or label attached to it when
where —
(i)eave is the average error of the packages sampled;
(ii)s is the sample standard deviation of the individual errors; and
(iii)SCF is the applicable sample correction factor specified in the fourth column of Table 1 in the Second Schedule.
(2)  In paragraph (1), “error” means the difference between the actual quantity of product in a package and the declared quantity of product stated on that package or on a label attached to that package, expressed as a negative figure if the actual quantity is less than the declared quantity.
(3)  For the purpose of section 19(6)(a)(ii) of the Act, in determining the appropriate number of non-standard packages in any sample of packages taken from a lot of packages —
(a)where the number of packages in the lot of packages is fewer than 100, the sampling plan in Table 1 in the Second Schedule is to be applied; and
(b)in any other case, any of the sampling plans in the Second Schedule may be applied.
(4)  In paragraph (3), “appropriate number of non‑standard packages” means the number of non‑standard packages allowed for a sample of packages.
Revocation
5.  The Weights and Measures (Defences under Section 19) Regulations 2005 (G.N. No. S 845/2005) are revoked.
