(Exemption for Sale of
Certain Personal Mobility Devices)
Order 2024
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and commencement
1.  This Order is the Active Mobility (Exemption for Sale of Certain Personal Mobility Devices) Order 2024 and comes into operation on 1 March 2024.
Definitions
2.  In this Order —
“non‑motorised recumbent device” means a personal mobility device —
(a)that —
(i)has 2 or 3 wheels;
(ii)has pedals designed to be operated by the rider’s feet;
(iii)is designed to be ridden in a reclined or partially‑reclined position; and
(iv)is built to be propelled solely by human power; or
(b)that —
(i)has 2 or 3 wheels;
(ii)has pedals designed to be operated by the rider’s hands, or both the rider’s hands and feet; and
(iii)is built to be propelled solely by human power;
“non‑motorised three‑wheeled pedal cycle” means a personal mobility device that —
(a)has 3 wheels;
(b)is steered by handlebars;
(c)has pedals; and
(d)is built to be propelled solely by human power,
and includes a tricycle but does not include a non‑motorised recumbent device or trishaw;
“tricycle” has the meaning given by section 2(1) of the Road Traffic Act 1961;
“trishaw” has the meaning given by the Road Traffic (Bicycles, Three‑wheeled Pedal Cycles, Trishaws and Recumbent Devices — Construction and Use) Rules 2024 (G.N. No. S 157/2024).
Exemption for warning notices relating to non‑motorised three‑wheeled pedal cycles and non‑motorised recumbent devices
3.  Section 31(1) of the Act does not apply to a person in respect of a requirement to display any warning notice stating to the effect that the riding of a non‑motorised three‑wheeled pedal cycle or non‑motorised recumbent device on any road is unlawful.
Exemption for sale of non‑motorised three‑wheeled pedal cycles and non‑motorised recumbent devices
4.  Section 33(1) of the Act does not apply to a person in respect of the sale or offer for sale of a non‑motorised three‑wheeled pedal cycle or non‑motorised recumbent device that complies with the Road Traffic (Bicycles, Three‑wheeled Pedal Cycles and Recumbent Devices — Construction and Use) Rules 2024.
